Mel Gibson Settlement

HUGE Loss for Oksana

8/31/2011 10:55 AM PDT BY TMZ STAFF

0831_mel_oksana_EX
The settlement struck between Mel Gibson and Oksana Grigorieva is nothing less than a financial fiasco for a woman who wanted untold millions of dollars from her famous ex.

TMZ obtained a copy of the original 2010 settlement worth $15 million that Oksana disavowed. At the time, Oksana said she would not go through with the settlement because she felt Mel was a danger to their daughter Lucia and believed Mel should not have unsupervised contact with the child.

In reality, sources connected to the case tell TMZ, the real reason Oksana walked away from the settlement is because she was advised she could get a lot more than $15 million because of the alleged physical abuse she claims she suffered at the hands of Mel.

Now, in a shocking twist of fate, rather than getting $15 million, Oksana is only getting $750k. On top of that, she was concerned about Mel having unsupervised visitation ... Mel is actually getting MORE unsupervised visitation based on the agreement that was just struck.

The fact is, under the 2010 agreement, Mel would NOT have gotten 50/50 custody until Lucia turns 3 years old. Under the current agreement, he gets 50/50 custody immediately.

Short story ... she should have taken door #1.

Deep Thoughts by Jack Handy

If Ox sold 200 copies of her CD under Mel's tutelage, fame and financial backing, how many CD's will she sell now that Gasbag and Horrowitless shamelessly promoted her in a court of law?

Hi everyone :o)

I love on that original interview with Horowitz when he says that he and Garbus were brought in to kick some butt. How'd that work out for you Dan? FOFL!

And Harvey stifling a laugh when Horowitz holds up the CD is too funny.

Sincerity

Some have posted that they thought she was put out in full view so that she couldn't claim she didn't agree with the terms etc., and that may be partially true. But normally, this matter should have been private and not in public view. That's what I find interesting. Anyway, I think she has ticked a lot of people off in legal circles. She has been using a lot of tax payer dollars for her personal vendetta, so I suppose it would only be fitting for the tax payers to see what they are paying for.

Hello Fuddy:

Remember that Ole Greedy accused the lawyers and mediators who were present during the May 2010 mediation of "pressuring" her into accepting the terms of the agreement that was produced from that mediation. By publicly disclosing the financial terms of this final mediation, they have effectively prevented her from using this maneuver in the future to "renege" on complying with the agreement's terms. It was quite obvious that she certainly was under no "DURESS" during these proceedings. In fact, it was "DOWNRIGHT" disrespectful on Ole Greedy's part to push her "WOEFULLY" pathetic music career during an "official" public hearing. It clearly demonstrated how "shallow" and "self-centered" she really is in regard to matters that concern others. Also keep in mind, this public proceeding helps to "shields" her attorneys of record from potential "malpractice" suits in the future. Judge Gordon was very wise in having another Judge who wasn't involved in the case preside over this hearing. Up until now, she's made a complete "MOCKERY" of our legal system and her days of playing the "VICTIM" have come to a "screeching" HALT!!! Frankly, I would love to see her play these games outside of California. The results would not be to her liking at all.

Greetings everyone

Can someone please explain why Mel is giving her $750K?

In the original mediated agreement, wasnt she getting 15M for her "silence"? and wasnt that agreement null and void once the tapes were released?
Whats the 750K for? She doesnt deserve a dime after what she has done to this man and his family.
When is Mel going after her for ruining his career, his name, his brand, ....pain & suffering to his family?
JMO but until the day Mel clears his name, and that means exposing her, his career will not recover.

Midwesterner

I believe that Mel and his attorneys insisted on having the financial deal made public. The public statement and video in front of a judge benefits Mel, not Ox. I think it was yet another piece of evidence that Mel at last had the upper hand in the situation.

While I think Fuddy may be correct about the outcome of the Kolodny challenge empowering Mel's side, I still don't discount the Sacha ER episode as the catalyst for settlement. There's a whole lot of difference between slamming a door and leaning on it, and the fact that the injury was to his arm, not his hand (as reported in the "spin" version) is significant. It seems more like an injury from flying glass shards.

If, and I say IF, Ox had at some point coerced Sacha into saying he saw or heard things he didn't actually see or hear that night he was supposedly hiding under the bed, several matters could be explained.

First, Sacha may have assured his Mama that he would say one thing in court while telling the child welfare sorts something quite different. That would explain why no one official ever thought Mel a threat to a child, despite OG's claims. (This discrepancy has bothered me since the beginning of this mess.)

And, second, the discrepancies between the planted story on Sacha's injury and the 911 call suggest an argument between mother and son that OG clearly wanted concealed. Is it possible that she was holding out hope of letting young Sacha tell his (or rather her) "story" in the media, or holding out hope that such a threat could increase the payoff? What if Sacha just finally said he wasn't going to support her schemes?

Sacha's old enough to be wondering about some of this stuff. There's no way he has been isolated from what's going on. Maybe he's had a bigger role in the saga than most of us believed. Maybe he's standing up to OG.

Hi Middie, Good to "see" you.

I agree. I think the young man may have just had enough. I also think Mel's attorney got the goods from Anteau, and she was scared. No other reason for her to fold.

A couple of things.

1) this hearing was public and settled before the custody hearing, is that correct?

2)Since that hearing was first, now the second hearing in front of Judge Gordon, Custody (seems to be resolved) child support and other, maybe that is what is going to rock the craddle, just pondering the what if's that have not been resolved. Hmmmmmmm

----------------------------------------------------------

Personally I feel the proceedings were done in open court to prevent her pulling the stupid kind of stunts she is well known for pulling. Knowing she is in the public eye will make her behave and act like the adult she is supposed to be. Remember her thanking the judge ? That would definitely be due to her wanting to present a good face to the public she hopes will buy her CD (in your dreams Oks). Mel's lawyers could easily have asked that proceedings be closed, but taped (to make sure there can be no claims of pressure or coercion).
Funny how Whorowitless has been banging on about how her final deal is actually better than the last one they rejected - saying it is actually worth $5m compared to the old settlement which, after taxes and what not, only came to $3m. That guy can spin faster than Schumacher's wheel, saying pig **** is actually tastier than cordon bleu.
I know people have been saying she doesn't deserve anything -- well Mel had to pay her something to make it a proper settlement acceptable to the courts. It wouldn't be a settlement if one party got all its own way. I'm glad it was only a "measly" 750K. You can bet your arse that Whorowitness and co will descent on that like the pack of vultures they are. Remember how they presented Mel with an outrageous bill (that even Harvey thought was outrageous) but Mel was only ordered to pay what seemed "fair and reasonable" ? Well guess who is going to feel entitled to that 750K now - hey Oks pay up since we got you a deal worth $5m. And Eric George will be taking a number and getting in line too. If you think about it, she will basically be left with nothing except free housing and what is leftover from child support after legal and other bills.
Like I said before, I think she is going to get a shock thinking her child support would go up. I doubt Robyn would be pulling in 20K for Tommy after alimony and other payments made to her by Mel. Mel will make sure as much as possible she doesn't get her maws on money duly entitled to Lucia. TMZ said so too. Her only hope now for a comfortable life is not to piss off Lucia and hope Lucia will support her in the future, or even ask her father Mel for money for Oks. Good luck Oks. With your lack of intelligence and street smarts and total lack of social skills and emotional intelligence, you will definitely need it.
