Proves Singer Was a Wreck

Lawyers for Dr. Conrad Murray want to show jurors just how worn down Michael Jackson was in the weeks leading up to his death -- and their proof ... MJ's blowout announcement for the "This Is It" concerts.

MJ held the news conference on March 5, 2009 ... announcing he would perform his last 10 concerts ever in London that summer ... insisting, "When I say this is it, it really means this is it."

Murray's defense team filed legal docs, claiming the video shows Jackson was rapidly deteriorating, both mentally and physically, when he made the announcement.  They're asking the judge for permission to show jurors the video, to prove Michael was literally on his last leg ... several months before his death.

Murray's lawyers also think the video is relevant because Jackson was "adamant" about performing only 10 shows, and that subsequently adding 40 dates to the schedule may have been the straw that broke the camel's back.

Huh TMZ, nice spin you put to your post. How funny that by changing a few words changes the tone of the article and TMZ certainly knows how to sensationalise their posts.

LOS ANGELES -- Lawyers for the doctor charged in the death of Michael Jackson want to show jurors at the upcoming trial footage of a press conference in which the singer spoke of performing in only 10 shows.

A motion filed Tuesday says the recording of Jackson as he announced his "This Is It" concerts would show his mental and physical condition in March 2009.

The motion says the footage supports the anticipated testimony of Jackson's makeup artist Karen Faye that the pop star was furious when he learned he would have to do 50 shows.

Lawyers for defendant Conrad Murray allege Jackson was not physically able to take on such a commitment.

Murray's involuntary manslaughter trial begins Friday with jury selection. He is accused of negligence in Jackson's death from an overdose of the anesthetic propofol.

I have watched the video a few times but I don’t see his mental and physical condition on it? Have defense got their x-ray classes on?
Btw, Michael wanted to do 10 shows in London 02 and then take his show to other countries. He was furious for 50 shows booked to 02, but whats that got to do with his mental and physical condition?
I would be furious too if someone pisses me off by booking my schedule for longer than I wanted. What this got to do with what happen 6/25/2009?
Didn't defence try this trick already? They looked hours of video footage from This Is It, and draw empty hand there. This is what happen earlier:

They argue that none of the TII is relevant, and they go as far as announcement of This is It looking for signs that Michael was ill! Hahaa!
Defense keeps trying to find something to show that Michael was ill of health, yet Conman’s own actions shows that he didn’t think there was anything wrong with Michael.
What about the argument Murray had with Kenny Ortega?
Conman was arguing with Kenny for sending him home when he was feeling well and Conman said Michael was ok? Here is the link to Kenny Ortega’s testimony:

What about the message that Conman sent to Lloyds the very morning when Michael died, he wrote to them Michael's health was good and was ready for the concert?
If they are trying to paint Michael ill of health, shouldn’t Murray as a Doctor be able to see whether someone is ill? He spent six days a week for at least six weeks giving propofol to Michael (according to his own words), not even a once he raised a red flag of Michael’s health!? Kenny (he is just a musical director, not a doc) saw one day that Michael wasn’t feeling well and sent him home, but Murray, (the doctor)didn’t see it! Their defense really doesn’t do any favors to Murray. If I were a juror I would demand mistrial (not sure can jurors do that?)and up the charges to murder 1 or 2.
Conman would be very stupid to let defense take this route that Michael was ill, because it is going to work against him. He is the doctor, he should have seen if Michael was ill and act accordingly (like real doctors do).

Everyone seems to be debating the ‘addiction’ issue as though it has some relevance in this case- BUT IT DOES NOT. If Murray was aware that his patient had any health or addiction problems, then that makes him MORE responsible – not less. To illustrate my point, all health professionals are taught to lock up any narcotics from treatment rooms when addicts are present. So, even if the jury could be convinced that MJ did indeed self administer (highly unlikely) - then Murray is still bears sole responsibility.

People are saying that MJ will be dragged through the mud throughout this trial, but I really don’t think so. Michaels drug history will be highly relevant in the Lloyds Insurance trial, (and the fans should be prepared for this), but in the Murray trial it is not. Put simply, the behaviour of the victim is not on trial here. His identity is irrelevant. The ONLY issue to be argued is the duty of care between doctor and patient. Judge Pastor intends to keep a tight rein on the proceedings and has already eliminated most of the testimony which sought to discredit the victim.

Murrays defence team do seem a little ‘green’ though. Legally, they only ever had two possible defences: either that the victim self administered, or that a third party gave the victim a medication which somehow interfered or combined with Murrays treatment to cause unexpected death.
The latter argument was always their best shot, and was obviously already in Murrays mind when he claimed he did not give MJ “anything which should have killed him”.

It is obvious that Murrays team intended to argue that Klein gave MJ demerol, and that excessive demerol and benzodiazapine medications are well known to produce insomnia. Murray would then have claimed that his decision to administer Propofol, though extreme, was the only recourse available to him. He would have claimed that, in this particular instance, Propofol was essential for his patient and that his judgement was based on sound clinical reasoning.

Like it or not, that is a valid argument.
So, I was very surprised that Judge Pastor chose to disallow this defence. In the interests of justice, I would have liked to have seen it argued in court. Moreover, I think Pastors ruling may provide grounds for a future appeal when Murray is finally convicted (which almost certainly he will be).

I read a report yesterday that stated that prescription drug deaths outnumbered traffic fatalities in the USA last year. The report claimed the surge was fuelled by “prescription pain and anxiety drugs that are potent, highly addictive and especially dangerous….".
So, I really hope this trial sets a precedent. I hope it sends a clear signal to all the other ‘Doctor Feelgoods’ that their behaviour will no longer be tolerated. Hopefully, a conviction may result in many lives being saved in the future.
I think MJ would be proud of that.

If Dr Murray's Attorney want to show how weak and worn down Michael was before the concert,what in hell was Dr Murray doing even feeding Michael "propofol"WHY was Michael NOT STOPPED.He was under the care of a physcian.I DO NOT CARE WHAT MICHAEL WANTED,it was up to the doctor caring for Michael to refuse to allow the concert.The lawyers better think that one over.

I like Tmz but if they can't show class by calling him michael jackson or just michael. We need to flood tmz and ask them just show repect to anyone you write a story about.

Can we stop all the posturing Dr. Murray, (and I use that term loosely), and admit that you effed up big time, and committed a crime by administering Propofol in an unlicensed setting, and then, as if that were not enough, you neglected your patient. Your medical practices are despicable and at the very least your license should be stripped, and you should serve time, for recklessly endangering and killing a human life....it does not matter that MJ was struggling. WE are looking at YOUR behavior, not his....

um after all the cack that happened in 2005 ,michael was a nervous at the time during this but he got better doing the end of the speech bless him,that murderer should go down for wot he did 2 him end of the day michael was never had enery thoughts of killing him self .

I don't see a worn out man in that video. I see a man happy, shy, and healthy announcing his last tour. I think he has bigger ideas for the future. Murray's team is really reaching.Raeding Jermaine's book and it makes me miss Michael even more!! Still MissingMJ
