Appeals Manslaughter Conviction

Dr. Conrad Murray has just filed an appeal, challenging his conviction for involuntary manslaughter in the death of Michael Jackson ... TMZ has learned.

Murray filed the document in pro per -- which means he's representing himself instead of using a lawyer.

On the portion of the document where a lawyer will usually state his or her firm's contact information -- Murray lists "Men's Central Jail" ... and includes his booking number.

While he is representing himself, Murray is still communicating with one of the lawyers who repped him in the manslaughter trial, Nareg Gourjian.

The first civil lawsuit in the Jerry Sandusky child sex abuse case at Penn State was filed in a Pennsylvania court Wednesday, as attorneys for the 29-year-old alleged victim outlined extensive abuse by Sandusky, the former PSU assistant football coach, including threats to the plaintiff to keep silent.

“This is focused on the institutional concealment and failure of Penn State and the Second Mile to protect kids from sexual predators,” said attorney Jeff Anderson at a press conference at the Omni Hotel in Philadelphia. “The lawsuit begs the question, ‘why did so many men for so long protect the institution of Penn State at the peril of so many kids?’ ”

Sandusky has been charged with 40 counts of sexually abusing children, including rape. He faces a preliminary hearing on Dec. 13.

The complaint filed Wednesday names Sandusky, Penn State and The Second Mile charity Sandusky founded, and describes an atmosphere of negligence dating back to the 1970s, a stretch of time decades earlier than the charges contained in a grand jury report released earlier this month charging Sandusky with sexually abusing eight boys over a 15-year period. The lawsuit includes eight counts, ranging from childhood sex abuse to negligence and negligent supervision, as well as intentional infliction of emotional distress and conspiracy to endanger children.

The suit was filed in the Philadelphia County Court of Common Pleas by Anderson, a prominent advocate for child sex abuse victims, and Cardozo Law School professor Marci Hamilton, who said at the press conference that they are filing on behalf of “John Doe A,” whose abuse was not disclosed in the grand jury report.

“This is an institutional case,” Hamilton said. “Two institutions that were tightly bound together, Second Mile and Penn State and the football program, in particular, that let Sandusky continue with his behavior.”

Anderson said he felt he had enough information to go to authorities Tuesday with his client’s allegations. “This was a classic demonstration of predatory behavior,” Anderson said. “Jerry was a kind, giving loving mentor.

Everybody loved him. He was in line to succeed Joe Paterno. He’s got millions of fans out there and he did great things with Second Mile, which reached out to hundreds if not thousands of troubled kids. But he was also cunning and predatory and couldn’t control his sexual instincts.”

Hamilton is scheduled to testify in Harrisburg Monday before the state’s Child Abuse Authority.

The plaintiff, now 29, met Sandusky in 1992 when he was 10 years old, according to the complaint, and was abused by Sandusky “over one hundred times” between 1992 and 1996. “John Doe A was too young to have given any consent, and Sandusky’s abuse was in fact unwanted and has caused substantial harm to John Doe A,” the complaint reads.

The man released a statement saying he is taking action to stop other children from being hurt.

“I am the man in this lawsuit and I’m writing this statement and taking this action because I don’t want other kids to be hurt and abused by Jerry Sandusky or anybody like Penn State to allow people like him to do it — rape kids,” the statement said. “I never told anybody what he did to me over 100 times at all kinds of places until the newspapers reported that he had abused other kids and the people at Penn State and Second Mile didn’t do the things they should have to protect me and the other kids.”

The complaint details the “multiple occasions and multiple locations” where the abuse took place: “. . . within Pennsylvania and outside Pennsylvania; in facilities of Penn State, particularly the football coaches’ locker room; at times within Philadelphia County; at facilities out of state connected with a Penn State bowl game; and at the Sandusky home.”

Sandusky threatened “John Doe A” and his family “if Plaintiff told anyone about the abuse,” the complaint continued. “The threat operated to silence Plaintiff and caused him to not be able to take any action until recently.”
“At the time he was still resisting and Sandusky told him, ‘Nobody will believe you and something will happen to your family,’ ” Anderson said.

“I have no doubt and John Doe has no doubt that other survivors are livid and furious that (Sandusky) is out free on bail and walking the streets,” Anderson added. “He belongs behind bars today and I believe he belonged behind bars long ago.”

Sandusky retired as Penn State’s defensive coordinator in 1999 but continued to have an office at at the university until recently.

“Penn State and Second Mile were each in a specialized position where each had knowledge that Plaintiff did not,” the complaint read. “Since both organizations were employers of Sandusky, John Doe A’s molestation was enabled by the negligent oversight of Sandusky by Second Mile and Penn State.”

The complaint continues, “Sandusky molested multiple victims through his activities with Second Mile and Penn State, dating back to the 1970s.”

“John Doe A” is prepared to go forward.

“I am hurting and have been for a long time because of what happened but feel now even more tormented that I have learned of so many other kids were abused after me,” he said in his statement. “Now that I have told and done something about it I am feeling better and going to get help and work with the police. I want other people who have been hurt to know they can come forward and get help and help protect others in the future.”

CM, thank you for saving the children in the world. For that, your sentence should be reduced to 10 days house arrest, which you have already paid by staying in custody all this time. On top you are not guilty, you are just a scape goat, not only for MJ' and his enablers but the whole American justice system due to the failure of recent high profiles cases, such as CH etc.

Scottie, sorry that you got food poisoning and didn't get beamed up. You will be in my prayer and God will take care of you or Karma. All fanatics of MJ are no more than MJ's conspirators for child molestation because they not only condone to pedophilia, they constantly trying to justify MJ's sin by making up all kinds of excuses.

I am challenging any one to admit that MJ is a molester and nonetheless still loves him regardless. I dare you.

SALINAS, Calif. — A man convicted of trying to sell his baby outside a California Walmart store is heading to prison for six years.

Patrick Fousek and Samantha Tomasini were arrested in June 2010 after witnesses told Salinas police that they were offering their 8-month-old daughter for $25.

Prosecutors said the couple were methamphetamine users and appeared high when they were arrested.

Fousek’s lawyer argued that the incident was a misunderstanding and his client was never serious about selling the baby.

The Monterey County man was convicted in October of child endangerment and possessing drug paraphernalia. A judge Wednesday gave him the maximum sentence of six years.

Tomasini previously pleaded no contest to child endangerment. She was sentenced to four years’ probation and placement in a drug treatment program.

The child has since been adopted.
