Cleared in Rape Investigation

forward Devin Ebanks -- a 2nd round draft pick in 2010 -- is off the hook in an LAPD rape investigation ... TMZ has learned.

Law enforcement sources tell TMZ ... the alleged victim told police Ebanks took her home from a nightclub on September 13, 2011 ... but when she turned down his sexual advances, Ebanks "forcibly penetrated [her] vagina with his penis five to ten times."

Cops say the woman reported the alleged incident to police later that night.

But here's where it gets crazy -- cops say the woman wanted to get Ebanks to admit to the sex, so she sent him a text message FALSELY claiming he had given her a sexually transmitted disease.

But Ebanks didn't fall for the trap -- and replied that he couldn't have transmitted anything to her ... BECAUSE THEY NEVER HAD SEX!!! 

We're told the woman also underwent a sexual assault examination, which revealed no foreign DNA anywhere on her body.

The L.A. County District Attorney eventually decided the woman had no credible evidence to back her story -- and rejected the case against Ebanks.

A rep for Ebanks had no comment -- but sources close to the Lakers tell TMZ, it's not the first time the alleged victim has made such accusations against pro ballers ... and law enforcement sources confirm that's the case.

Did anyone even consider that there could be more facts they are not giving us? He could of possibly had on a condom, which could be why there is no DNA evidence. It could also be why he denied it through text because he was positive he either had no STDs, or he wore a condom and was almost sure he didn't pass anything to her. My guess is he is rich and knows he is clean? Also why would anyone admit anything via text even IF they did anything? I think it's unfair how so many rich people can get away with just ANYTHING because they have money.

They should throw this bitch in jail for life. That is the crazy result of the feminist movement. These bitches want to use past horrors caused against them to justify modern day pay back against today's man.

Now, we have these bitches throwing accusations at people for rape - with possible life long consequnces in prison. And what if the bitch is lying? Nothing happens. That is a great disconnect. From a man doing life in prison as a rapist to a woman who has a history of making false rape allegations and nothing happens to her.

Make the bitch do the time she accused this guy would do if convicted. That should send a strong message to these bitches that they are taking out their frustration on the wrong guys.

If you want pay back - find a time machine and go back in time to punish the men who exploited you. Don't try to blame modern man for past atrocities.

well.. she tried. You'd think there would be a law against that with SERIOUS consequences. An accusation like that could potentially bankrupt a person in legal fees--while the criminal walks. If it's determined that the claim is bogus than a crime was committed. Increasing the world "crime" has become a joke when you consider how the courts doles out sentencing. You can count on one hand the number of millionaires in prison [and trust me, it had to be REALLY SERIOUS and even at that they are sentenced a 10th of what the average Joe would receive for much lesser crimes. But it's backfiring... everyone has discovered how the game is played and hiring their lawyers and really screwing things for the good old boy/GIRL network

I never believed her story. Nobody goes home with a man right after they meet him at the club and expect to play uno. Some women are just so decieving they'll go through desperate measures to take money from a brutha. I'm sorry but you can't rape the willing. Instead of LYING to get money she should probably get off her back and get a damn JOB.

Shouldn't she be charged criminally then? If she has a history of this why was he even investigated? I say any time a woman makes a false claim of rape she should get the same jail sentence as the guy would have gotten for the crime she falsely accuses him of.

Here are the facts:

1. It happened.

2. The cops TOLD her to send that text message; the cops were trying to get her to trap him into admitting they had sex (obviously he would never just come out and admit it).

3. Although there was no DNA evidence, there WAS evidence of forced penetration and other injuries; this is often the case when the rapist uses a condom (hence, the condom) and the victim takes a shower (as happened here).

4. This is the ONE and ONLY time this woman has ever accused someone (pro ballplayer or not) of raping her; any assertion to the contrary is a blatant falsity.

Remember: lack of evidence is not evidence of lacking. Rape cases in which there is no DNA evidence are very hard to prosecute. The prosecution must prove their case beyond a reasonable doubt. If a prosecutor does not feel that they can prove a case at this standard, they generally will not pursue it. This, however, does not mean that the event did not, in fact, occur.
