Sued for Using 'Eye Of the Tiger'

at Political Events

Newt Gingrich is being sued by the company which owns the rights to the 1982 song, "Eye of the Tiger" -- claiming Newt had no right to use it as part of his campaign.

Rude Music Inc. -- owned by a member of the band Survivor -- filed the suit today in federal court in Illinois ... claiming Newt has jacked the song made famous in "Rocky III" to push his political agenda.

According to the lawsuit, Newt has been using the song at various political events since 2009.

In the suit, Rude Music claims Gingrich used the song at the Conservative Political Action Conference in 2009, 2010 and 2011 ... as well as the Southern Republican Leadership Conference in 2010.

RMI claims Gingrich -- along with his campaign team, Newt 2012, Inc. -- recently  used the song during a campaign event in Doylestown, Pennsylvania ... claiming, "Mr. Gingrich entered the packed Moose Lodge for a speech as the song 'pulsed,' according to the the Newt 2012, Inc. website."

RMI is also suing the American Conservative Union -- claiming it has republished various clips featuring Newt and the "Eye of the Tiger" song without permission.

RMI is asking a judge to order Newt and his team to stop using the song ASAP -- plus, the company wants unspecified damages.

Gingrich isn't the first G.O.P. candidate to be sued for using music -- back in 2008, Jackson Browne sued John McCain for using the song "Running on Empty" in a political ad.


A rep for Net's camp tells TMZ ... "It is my understanding the band wants $200,000 because someone played their song.  That's one expensive concert ticket."

How is this illegal? You buy the CD, put it in a player and play it at a conference? If you say because it's in public, well, then what's the difference in playing the CD loud in your car for others to hear it? This is a BS lawsuit.

There should not be an issue or legitimate lawsuit if the parties being sued paid the licensing fee to BMI or ASCAP to use the songs at a meeting/party or event. The copyright holder loses the ability, other than publicly complaining, to stop use of the song (i.e., "Heart" and the use of "Barracuda" to promote Sarah Palin's nickname) once the proper licensing fee is paid to BMI or ASCAP.

Obama's campaign had to stop using a song at rally's when the copyright holder publicly complained, but Obama-08 was not legally required to stop using it.

The Jackson Browne suit was different as "Running on Empty" was used in a political commercial and thus needed permission from the copyright holder. The person at the Ohio Republican party that created the ad thought that by legally paying for the song on ITunes, they had the legal go-ahead to use it in the Pro-McCain ad....wrong.

You cannot use a song without the copyright holder's permission to sell cars, candy bars or video games. Or without paying for the use of that song. Same with music used in TV shows, movies, theatre plays or concerts. Why should politicians be allowed to sell their BS with somebody's song blaring in the background without asking for permission and paying for it?

Obama can play any music he wants because Obama is the good guy. Republicans are the "not so good" guys. Most of us still have our memories intact and know it was Republicans who ruined our economy. Only a nut without a brain would want the GOP back, at least until they regain their memory, realize everything they did wrong, and then tell us, ahead of time, HOW they propose to fix their own mess, and it had better be something more than "well, we're going to take all your money, lower your wages, and deny you affordable health care." Republicans have got nothing, absolutely NOTHING in store for working people.

Republicans = Tax Cuts for the Rich, Pay Cuts for working Americans.

The Suit Against American Conservative Union Sound to be a Reckless Suit based (Maybe) on their left leaning Ideals. If a Music Group does Not want a Political Party or Movement (from conservative ,free market capitalism OR liberal collective, socialist) The Music Group SHOULD Put On their Record Label or Album a Disclaimer that 'more or less' Reads "This Music Group .... does Not Support this Ideal...", Therefore It Would Be Fair For ALL PARTIES Involved (This Music Group and The Party or Movement)..The consumer can make a decision to by the Album and the Music Group has the Right to Discredit that Political Party or Ideal from Using their Music.
