Joe Francis

Beats Madonna

2/27/2012 12:50 PM PST BY TMZ STAFF

Joe Francis has scored a victory against the likes of Madonna without ever having to set foot in a courtroom ... because she has changed the title of her new song "Girls Gone Wild" ... as well as its lyrics.

You may recall ... just before the Super Bowl, Joe and his lawyer David Houston fired off a cease and desist letter threatening Madge with legal action if she sang the song during her halftime performance, and also demanding that Madonna make things right on her new album.

Well, apparently Madonna and the record label, Interscope, have seen it Joe's way ... because we've learned they have agreed to change the song title to "GIRL Gone Wild."

We've tracked down the new art for the single ... and they've clearly taken the S out of "Girls" (below).

The battle's been won ... but Joe tells TMZ, the war's not over -- "Clearly her label was trying to avoid legal action surrounding the song ... BUT [the new title] is still infringement as far as the law is concerned, and we have been in touch with Madonna’s people in an effort to resolve this issue."

Joe says he'll pursue new legal action if the Madge squad doesn't make further changes to the title.

LOL how can Madonna think this is OK to use without Joe Francis getting some credit.. Maybe she should also put a song out called "Facebook" and "Coca-Cola" and maybe even "Mobil Oil"

Can someone just make this guy go away already? I never knew he owned words that have been in the dictionary for years! What next, sue Merriam Webster? Can't wait for Karma to catch up on him a little more.....

... And just why exactly did TMZ posted a pic of a shirtless Francis for this story?
Does a staffer over there actually has a crunch on the douchebag? Yeah, what a catch, I tell ya.

Anyway... I actually detest Madge way more than him, so Go Joe!

Joe should let Madonna use the song title BUT as long as she appears in a GGW video like Snoop Dogg did a while ago.

Hey Joe -- Crawl back under the rock from whence you came. The other maggots miss you.

I understand the whole "Girls Gone Wild" lawsuit but you can't copyright every single word or phrase. Girl Gone Wild isn't Joe Francis' phrase. It's a free country and although I can't stand Madonna, she has a right to use that as her song title. Sheesh, everybody wants to make money off other people's words.

Girl Gone Wild has been the title of the song from the beginning. Websites were reporting it wrong. If you go back and look at the original artwork, you can see it was titled Girl Gone Wild. Also, the lyrics in the song say "Girl Gone Wild" ... The CDs with the lyric "Girl Gone Wild" were pressed long before he issued this moronic cease and desist.

Go back to beating women and getting underage girls drunk, Joe.

I would say Madonna has won because it avoids giving him cash (so far).
