isn't out of the fire for tossing a paparazzo's iPhone -- New Orleans police have issued a warrant for his arrest.

New Orleans PD tells TMZ a misdemeanor warrant for simple criminal damage to property was issued tonight ... following Brand's run-in with a pap on Monday.

Brand is accused of grabbing the photog's iPhone and hurling it through the window of a nearby law firm.

As TMZ first reported ... people connected to Brand contacted the law firm and said the actor would be willing to pay for the damage to the window.

Russell is still in New Orleans filming a movie. We contacted a rep for the production ... who refused to comment on the warrant.

There have been thirty-three homicides in New Orleans since January 1st. Russell Brand did something stupid and childish. Yet, he is willing to pay. So let him. There is zero reason to waste taxpayer money and police manpower on a misdemeanor crime where the offender is willing to make financial restitution.

And, no, I don't mean that the rich should buy their way out of crimes. I absolutely do not mean that. I simply mean that its a window. Pay for it. Its more expensive to process and prosecute a crime like this than the cost of the damage.

Don't we all know what ****s those paparazzi's are? This is so stupid. He's paying for the window, which was not a big deal, but to haul him into a police station for this is ridiculous.
Why can't people with cameras understand the simple words that convey enough is enough?
