REJECTS $200k Settlement

in Airplane Propeller Accident

Lauren Scruggs -- the model who lost a hand and an eyeball when she was struck by an airplane propeller last year -- claims she shot down a $200k settlement offer from the plane's insurance company ... and now she's suing for much, much more.

Scruggs filed legal docs in Dallas, Texas ... claiming the insurance company "verbally offered" to pay her $200k for the Dec. 3, 2011 accident ... and they explained it's the MOST the insurance company can pay out to a "passenger."

But Scruggs is calling BS ... claiming she shouldn't be considered a "passenger" because "she was not in the aircraft or getting in or out of it at the time of the incident."

The 23-year-old model argues she had "completed her exit from the aircraft prior to the time of the incident and was physically located on the tarmac when the incident happened. Until struck by the propeller, she was not in physical contact with the aircraft after her exit."

Scruggs is asking for unspecified damages ... but we're guessing she wants WAY more than $200k.

She walked into the prop, the plane was not moving. It's like saying someone walking into traffic with no regard is not at fault.

I feel bad for what happened to her, but I don't think she should be suing for such a large amount of money. Even though she was terribly hurt, she has to take some of the blame herself. She was the one who walked into the propeller.

Under what theory would there be any liability on the part of the airplane manufacturer, the operator, the insurer of the operator,etc.? This is precisely what is wrong with our judicial system- it is time for massive tort reform!

This incident no matter how awful and undeserved, was in fact, HER FAULT. She should get nothing. Once you exit a plane you have to leave the tarmac, that is federal law, so if she doesn't want to be considered a passenger, then she should be fined for trespassing for attempting to return to the plane to retrieve a scarf or whatever it was. She walked into it. I don't understand how because I have been on small planes and the prop is loud and visible as well as the wind it creates. How do you walk into something like that. I think she is taking her stupidity and poor judgement and trying to convert her regret into a platform that should not exist......she's just an idiot and no one else is to blame....

She should be lucky that she was offered $200k especially since it was HER FAULT! The pilot even told her to watch out for the propeller which she ignored! When are people going to start taking responsibility for their own actions! Maybe she should've been using some of her modeling money to buy health insurance like the rest of the responsible population!

Here is another classic case of people not taking responsibility for their own stupidity. I am relieve that she was not killed and she should definitely thank whomever she believes in that she did not meet whomever she believes in, but the fact of the matter is that she walked into the propeller of a stationary object, the stationary object did not move into her. This means she was not paying attention. She should not get rewarded with a windfall of cash for not watching where she was going.

Pain and suffering in Texas is capped at 250k, so if the claim is solely on pain and suffering that is all she will get. Now, she can sue for her medical costs separately, but if the insurance for the plane company only held 200k in insurance, then the 50k will be hard to obtain. And that's why people who screw the justice system, screw people who actually have a case :)

Did she forget that it was her own fault? What a worthless person for trying to blame her own ignorance on other people. Anyone with half a brain could identify the risk of walking next to a propeller. What a dumb ****.

What actually happened is the pretentious vain "model" wanted to take a photo of herself in front of the plane to put on her blog and gloat, she SO BADLY wanted to gloat that she ignored the pilot when he tried to direct her away from it. Absolute stupidity and self absorbness BUT she didn't deserve to lose an eye. The incident is really quite sad, though hopefully that'll teach some of those squealing Facebook obsessed women to settle down with the photo-taking. You don't need to take photos all day long, there's no such thing as having fun anymore, instead of fun they posebpouting in front of a "fun" situation which they're missing out on because they're too busy being vain.

She deserves more then 200k only becausebmedical bills shouod be covered, but nothing else, see shouldn't be compensated other then the bills because it was almost entirely, her own fault.
And dye shouldnt sue for loss wages because she is no vogue model...every 2nd girl is a self proclaimed model these days. Yu just basically need to have a face ofbsomebsort, and a camera and BAM " I'm a model"'she's a pretty girl obviously, but pretty doesn't not equal model- model shouod mean " a person who makes decent money promoting an item or brand through photographs,runway, or film" not someone who takes photos of themselves in front of some random staue in the park.

I don't want to seem mean or rude but....this is her fault. She walked into the propeller. She wasn't paying attention to what she was doing and it's her problem. I am amazed that she feels she deserves more money for her own stupidity.

Not sure how I feel on this one. On one hand (no pun intended) she should not have been allowed near the prop. However, she should not have been dumb enough to walk into it.
