Sued by Same-Name Band

British boy band One Direction is being sued by a much lesser known American band -- also called One Direction -- and now, the Americans are out for blood ... demanding the Brits change their name.

The U.S. One Direction just filed the lawsuit, claiming they formed in 2009 -- an entire year before the UK band members even knew each other -- and have since developed a considerable following this side of the Atlantic.

In addition to building a reputation around the name, the Americans claim they also beat the Brits in a race to the U.S. Patent and Trademark Office -- filing a trademark application for "One Direction" long before their UK counterparts.

Now, the Americans are asking for a court order -- requiring the Brits to change their name.

The Americans are also suing Simon Cowell's record label and Sony Music -- demanding more than $1 million in damages.

The British band -- which was formed by Simon Cowell in 2010 while members competed on the UK "X Factor" -- has yet to respond to the lawsuit.

A lawyer for the UK band tells TMZ, the group plans to fight back -- claiming, “[British] One Direction’s lawyers now have no choice but to defend the lawsuit and the band’s right to use their name.”

It just so happens that not only does the US version have the same name, they also look almost the same except stoned. Very convincing argument, indeed.

really I live in the US and I never heard of one direction (the US one, so them claiming that it is confusing their fans is a bunch of.... My daughter has googled the one direction name several times and the US band has never came up. The American band needs to get over it.

I find it a bit strange that US One Direction decided to sue NOW that UK One Direction is a big hit. They seemed to have no problem with this before UK 1D was topping the charts... curious.

The british One Direction should keep their name! I've spent SO much money and time creating One Direction stuff and for them to change their name would make all that money go to waste! It wouldn't be fair to the fans.

im from the US and nobody knows the US one direction. theyre just jealous because the UK 1D aka THE REAL ONE DIRECTION is attractive (unlike them) popular (unlike them) have amazing voices (unlike them) and have sold out major arenas in matters of minutes (u n l i k e t h e m ) UK 1D will obviously win so get over yourselves american 1D and change your name xx

I'm an American and I've never heard about the US One Direction. It's kinda funny how once the UK One Direction became famous the US one sued. But the UK band is from England and Ireland, how would they know about a no name band from America? It makes me angry that Americans act like this sometimes. Can they work things out without trying to sue the UK band? And 1 million dollars? That's a bit excessive. They just want money. Congrats, you filed a US patent. Does that even matter in the rest of the world?

It should be known that the US 1D does not even write or record their own songs and they don't even have a solid band. It's all being driven by the singer’s dad “Dan O’Leary”, who wants his kid to be famous. The problem is, the son has no talent at all. That's why they hire a band to do it for them. Ever wonder why you never see a live video of them? US One Direction is a total fraud. The real band that writes the music for them is called “The Mess” - Mike Gross writes and records all the US 1 D music. TMZ you are the best at fact finding, so get a hold of Mike Gross, he’ll be happy to tell you he was hired because the US 1D can’t do anything, they aren’t even a real band. US 1 D is a total fraud.

The law suit is complete bull. I've never once heard in my life anything about one direction in the US. UK's one direction is certainly more popular then them. Why are you going to make one of the biggest bands in the world at this moment change there names and disappoint all of there fans. Even if the US's one direction had the name first, they should put all the facts together and maybe they would realize that UK's one direction might win this. I think that they're using this as an excuse to become more famous and to get money. Pathetic.

Gay, gay, gay, gay. No one had ever hear of these supposed 'US One Direction" so they're doing it for money, which is entirely pathetic. No Directioner really cares if the 'US One Direction' had the name first. They all agree that they wouldn't have been as famous as UK One Direction. So yeah this is STUPID emphasis on STUPID.
