-- the stuttering "America's Got Talent" contestant who says he developed his speech impediment from a war injury in Afghanistan -- is firing back at allegations he made up the whole thing ... telling TMZ, his injury and stutter are 100% legit.

Poe's audition aired Monday night -- the singer told the judges about a 2009 incident when he sustained serious injuries during an RPG blast in Afghanistan.

Poe spoke with a pronounced stutter during the audition -- which he claims he developed as a result of his war injuries.



But reports surfaced yesterday that the singing veteran was full of crap -- because no such RPG injuries were ever reported.

Poe tells TMZ, the fact that there is no record of the incident is a common problem -- one that Poe says is endemic when it comes to reporting soldiers' injuries in Afghanistan.

We asked Tim to prove it really happened.  He said he received treatment at a military medical facility in Afghanistan before being transferred to a medical center in Landstuhl, Germany. Tim says he was then transferred to Brooke Army Medical Center in San Antonio.  He did not produce any documents to support his claim.

Tim says he plans to sue his ex-wife and several others for telling the media he was lying.

We asked Tim for ANY hard proof to back his claims -- he gave us nothing, saying he can't release pics or documents for legal reasons. So we gotta ask ...

his records can be obtained by the freedom of information act. why can't we have performers perform for their talent and not their personal history.
Let their talent speak for itself! ( these pre-stories are to pull at heartstrings.) Just show the talent.

Just so everyone knows. My father who passed away one year ago just got his medals only a week before passing away and he served in the Vietnam war and was wounded. It took all those years to go by and alot of research to prove and show who and where he was in order for him to get the medals he deserved so please consider that before saying he's lying.

My boyfriend is an Army SSG. When he was serving in Iraq his best buddy was blown up at a checkpoint =( The video is on youtube - no legal reason you cant produce a picture of an injury. Total BS!

You really going to make fun of someone who nearly died in some stink-hole country, trying to protect your freedom to print absolute garbage like this? I hope that the author of this gets half blown to crap, then we'll see how funny they think they are.

Who writes this garbage? I can't wait till this POS "news" organization goes down like "News of the World" this kind of writing (it feels wrong to even call it journalism) is absolute trash.

Stupid people... He never said he broke his back in Afgan he just said he was out of the military because his brain injury and broken back ended his career..

There is not always blood or even marks for a brain injury nor do they show up right then. He could have had headaches to other issues and then as things were happening in his head it got worse.

Oh and so what the National Guard gave out his history with THEM... he could have been in the Army for years before...

Funny how just a few months ago dateline was doing stories on Vets screwed because of paperwork but you guys have short memories..

They said he was in Afghanistan for a month in 2009. I've been deployed five times but never for just a month. The only reason to do so little time is if you were injured and had to be sent back home. As for him not having a purple heart to show for is the weird thing unless it was a friendly fire incident.

I can tell you for a fact after spending over 20 years in the Military that for Enlisted Men, there's a LOT of things that never get in the record and also many times they never receive awards because Commanders will issue it to whoever the Officer was over the unit. Seen it thousands of times, literally. The" Officer's corps" is the most corrupt institution in the history of the planet.

Not sure what to believe. But think about it, this show takes something spectacular to win. His singing, no so spectacular. Playin a guilt trip can get u pretty much anywhere. If he's lieing, there's probably a million americans ready to kick his ass. Wouldn't rely on showing the purple heart either. You can get knock off purple heart awards anywhere now.

I am the Mom of a child who stutters and his stutter seemed very real to me. Our speech pathologist told me to try to stutter to see how hard it really is...it is too much work to fake. Try it for yourself. As far as if his injuries are true, what kind of person would say otherwise except for a scorned ex wife that thinks she can damage his chance of winning money...maybe she is so bitter that she will say anything to hurt him...just saying. I think the stutter is real and he didn't have it before he went into the war so that is enough truth for me and it should be for everyone else. THANK YOU TO ALL THE SERVICE MEN AND WOMEN OUT THERE. My nephew came back home from Iraq and he was never the same mentally. There are injuries a medical professional can not gage....so how can all the nay sayers on here??
