insists ... her brand new Lamborghini is being held captive by an Illinois car dealership -- after she paid handsomely for the luxury vehicle -- and now, she's suing to get her ride.

The rapper filed the lawsuit in Florida against Fox Valley Motor Cars, claiming she entered into an agreement with the dealership last year to buy a 2012 Matte White Lambo Aventador (below, in orange) for $376,000.

According to the lawsuit, Missy -- repped by Singh, Singh & Trauben -- agreed to make a down payment that included $30,000 in cash AND her 2005 Bentley (valued at $85,000). In return, Missy claims the dealership agreed to ship her the Lambo by mid 2012 ... but never did.

Missy says she contacted Fox Valley for an explanation -- and was told the terms of the deal had changed because the market value of the car had risen.

According to the lawsuit, Fox Valley refused to deliver the car for the agreed upon sale price -- and demanded way more money in exchange for the vehicle.

But Missy says that's BS -- and now, she's suing Fox Valley for possession of her Lambo, plus damages resulting from the dealership's breach of contract.

Calls to Fox Valley weren't returned.

It seems pretty cut and dry, she entered into a contract to purchase something at an agreed upon price for delivery at a later date. Pre-sales are good for the business entering into such an agreement because it gives them capital to work with before they have to lay out any expenses to secure the vehicle.

But it depends on the specific language of the contract. If it was simply a reservation, and the purchase itself would be completed later, then Missy E. won't be able to do much but cough up more dough. Depending on how it's worded exactly, she may even have to forfeit her down payment if she doesn't follow through on the purchase.
The lawyers will work it out.

I'd like to get me a Tesla Model S. That car is THE cutting edge in car technology. Super fast too. 0-60... mph in 4.4 seconds. The Wall St. Journal has an excellent review for this car. I think this car is a true world changer.

I don't get it. Why are people saying that she can't afford the car? If she wanted to pay for the car in full she would of ( if she did, they might had even STILL told her to put more money down because of the value going up if it was on hold). "if you can afford a car in full don't buy it" what kind of people are saying this?...go down to your nearest Honda dealer and put "cash" down on a loaded Accord paid in full...uh yea....not to many average joes can get a car in full cash. But in this case we don't know why she didn't pay in full, and her reasons are her reasons.
