First Lawsuit

James Holmes mug shotOne of the victims in the James Holmes mass murder spree has lawyered up and plans to file a lawsuit ... because he feels the theater dropped the ball in a very fatal way.

Torrence Brown, Jr. was in Century 16 Theater when Holmes let loose.  One of Brown's best friends, A.J. Boik, was shot in the chest and died.  Brown, who was not physically injured, claims to now suffer from extreme trauma.

Brown has hired attorney Donald Karpel to rep him.  Karpel tells TMZ ... he is targeting 3 defendants.

1.  The theater.  Karpel claims it was negligent for the theater to have an emergency door in the front that was not alarmed or guarded.  It's widely believed Holmes entered the theater with a ticket,  propped the emergency door open from inside, went to his car and returned with guns.

2.  Holmes' doctors.  Karpel says it appears Holmes was on several medications -- prescribed by one or more doctors --  at the time of the shooting and he believes the docs did not properly monitor Holmes.

3.  Warner Bros.  Karpel says "Dark Knight Rises" was particularly violent and Holmes mimicked some of the action.  The attorney says theater goers were helpless because they thought the shooter was part of the movie.  Karpel tells TMZ, "Somebody has to be responsible for the rampant violence that is shown today."

I am truly sorry for the victims of this horrible event and their families. I can understand the theater if that is truly how he entered and then went back out. I can somewhat understand the doctors however there isn't a universal medical charting system that doctors chart on so if he's going to numerous doctors and is lying about it how are the doctors at fault?!? and now for the 3rd defendant Warner Bros?!?!?! Are you kidding me? How is it by any means there fault some psycho did this horrible thing? So can I sue A & E if some idiot blows up a meth lab in my neighborhood because they watched too many episodes of Breaking Bad? I highly doubt it. I highly doubt this guy was been planning this since the last movie came out and decided now is the perfect time. He has major issues no doubt about it but I highly doubt Warner Bros. is responsible in any way. I am for people to have guns if they have a concealed weapons license. Now why aren't they going after the gun companies? Wouldn't they just be at equally or same fault as Warner Bros.?? I swear people will use anything and everything to get money its truly sad that he's doing it over so many peoples tragedy. I'm sure he'll have anxiety issues for a while but he wasn't injured physically.

Seriously? Money hungry SOB... Yeah, it's terrible and I feel so bad for the victims. But to sue at a time like this? Really? 1) the movie theater could NEVER have seen this coming. Emergency doors are like that at pretty much every theater. 2) The doctors could not have known that he would do this. It is in NO way their responsibility unless he told them he was homicidal and they ignored him, which does not appear to be the case. 3) WB? Really? What a dick.

I've read where they can not even find proof that he even knew any of the people who died. He is saying that one of his friends were killed, but the person they are saying that died, was with another person who says he didn't even know this Torrance guy. Who is to say this loser was even at the theater. Just like 911, all those scammers that came trying to cash in saying they were in the building or lost loved ones when they were just out for money. This guy has NO CASE.

Wait a sec. Someone who wasn't even shot is suing not only the theater, but Holmes' doctors and Warner Bros.? This case better get thrown out immediately or else the actual victims and their families will have a field day with this tragedy. And just imagine the repercussions it could have on the psychiatric field, Hollywood, and movie theater chains.

So Brown is suing WB because the movie was too violent? Yet he showed up to watch it. That right there tells a studio that its ok. You don't want violent movies, don't watch them. If enough folks don't go to watch a movie, either that franchise, or that genre will get a harder look at the next time a script comes around.

That is what I like about the United States. Beside the murderer you can sue them all and get some greedy lawyer to go on with the lawsuit for a percentage of your score.
