Victim's Mother Ready

to Sue Movie Theater

0729_james_holmes_aurora_tmzThe mother of one of James Holmes' massacre victims has hired a high-powered attorney to sue the Aurora, CO movie theater where he opened fire ... killing 12 people, and injuring 58 others.

TMZ has learned Shirley Wygal is retaining a lawyer in Los Angeles to handle her case -- and we're told she plans to go after the Century 16 Theater.

Shirley's 32-year-old daughter Rebecca Wingo was shot and killed in the theater.

Sources close to Shirley tell us she believes the theater's emergency exit doors should have been alarmed, or there should have been security guards posted next to them ... especially for a premiere as anticipated as "The Dark Knight Rises."

Witnesses say Holmes entered the theater through an emergency exit door and then started shooting. Authorities think he may have propped the door open earlier from inside the theater.

TMZ broke the story ... a survivor of the shooting spree is planning a similar suit, but he also intends to go after Warner Bros. and Holmes' doctors.

We've reached out to Cinemark -- the theater's corporate owners -- but no reply yet.

Holmes will be in court Monday morning to be formally charged in the massacre.

I feel for all the victims but this is not right that the parents sue the theater---are you kidding me? Securty Guards? What movie theater does? It is that freaks fault that this happened and NO ONE elses!!! I do not agree with the sueing whatsoever!!

Those emergency doors should have been locked from the outside. The movie theater security should always complete a building walk around to make sure all doors are lock and nothing is suspicious around the building...it is part of their job. Also I have seen the movie theater employees check to make sure those exit doors are closed.

How sad is this. Her daughter just die and the mom is just thinking how to get the most money she can from somebody.
Somebody has to pay for her daughter's life. I can hear the daughter saying: Mom, I'm dead and you are just thinking how to make money? C,mon!"

Its sad that these media companies only go by their own accounts. They never once mentioned the eye
witnesses who stated in interviews right after the shooting that a man got a call inside the movies and opened the exit door for holmes who then opened fired.

Dear TMZ, please do your homework. Witnesses in the theater (Corbin Dates for 1) saw a goateed man who was NOT Holmes enter the theater before DKR began and take a call peculiarly enough at the emergency exit. The man was seen propping open a should-have-been-alarmed emergency exit door, signaling another party to enter the theater and spray the audience with bullets. Another witness said the 2nd smoke canister came from the OPPOSITE side of theater where the gunman stood. Hmm. No surveillance footage? Huh. That's weird. And in under 2 minutes, SWAT and local police arrive find a dazed, de-suited and unarmed Holmes in his car looking as drugged up as he did in court. There's a blood trail outside the emergency exit. Holmes has ZERO wounds, as he gave himself up. Sounds like Holmes is a fall guy to me. Rigged apartment? Planted evidence. A 2nd grade drawn notebook with an alleged plan sent to a doctor? Anyone can mail anything with anyone's name in the return address. Ammunition? Anyone can buy anything with stolen credit card information. Pretty damn suspicious if you ask me...or if you're a journalist. If Holmes doesn't take the stand, you know it's because this is a complete set-up.

Sure is interesting how TMZ has ignored the witnesses statements saying that 1) a goateed man that was NOT James Holmes entered the theater, sat in the front row, took a phone call toward the emergency exit and propped that door open (no alarm) and then another individual entered several minutes into the movie and started firing and 2) a 2nd smoke canister came from the opposite side of the theater where the gunman stood. And within 2 minutes James Holmes was found in his car with no equipment on dazed and confused like the same way he looked in court. PRETTY ****ING SUSPCIOUS HUH?

White trash justice. Dead family member? Sue the deep pockets. Where's the suit against James Holmes? Oh that's right--you cant get enough money to buy cigarettes from the perpetrator. Is your daughter even buried yet? Who contacted who--did you call the ambulance chaser or did he call you? Shirley's a disgrace to her daughter's memory.

Maybe suing them will bring the victim back? She should go back and sue every other theater she has ever been to just on the premise that it "could of" happened to anyone at anytime. Whats next? I feel horrible for their loses, but be rational, and if you think a quick large settlement will "show them" or make you feel better...it'll never work unless you have the mind set that a settlement will take away the pain....then in that case...how special was your loved one? Really? Is their a price tag for a life?

People usually exit those "emergency" doors after the final showing. They are not alarmed at ANY theatre in my town. They are emergency doors only in the sense that in case of a fire, people can exit the structure immediately and not have to go through the lobby. While I feel for the loss of her sister, it is in no way the theatre's fault, or Warner Bros. This suit is either misplaced anger or pure opportunism.
