Victim's Mother Ready

to Sue Movie Theater

0729_james_holmes_aurora_tmzThe mother of one of James Holmes' massacre victims has hired a high-powered attorney to sue the Aurora, CO movie theater where he opened fire ... killing 12 people, and injuring 58 others.

TMZ has learned Shirley Wygal is retaining a lawyer in Los Angeles to handle her case -- and we're told she plans to go after the Century 16 Theater.

Shirley's 32-year-old daughter Rebecca Wingo was shot and killed in the theater.

Sources close to Shirley tell us she believes the theater's emergency exit doors should have been alarmed, or there should have been security guards posted next to them ... especially for a premiere as anticipated as "The Dark Knight Rises."

Witnesses say Holmes entered the theater through an emergency exit door and then started shooting. Authorities think he may have propped the door open earlier from inside the theater.

TMZ broke the story ... a survivor of the shooting spree is planning a similar suit, but he also intends to go after Warner Bros. and Holmes' doctors.

We've reached out to Cinemark -- the theater's corporate owners -- but no reply yet.

Holmes will be in court Monday morning to be formally charged in the massacre.

Who could just go into a movie theater and start shooting innocent people. Either he didn't have a heart or there is something seriously wrong with him mentally, which he has not gotten treated for. How can something like this just happen just because of a batman movie. I keep on imaging him just walking into the movie that everyone is enjoying with their family until he just starts randomly shooting at people. Why do events like this happen. I think people need to speak up more when something does not look right. People need to be more observant and report suspicious activity even if they think they are overreacting. How can somebody do this.

Here we go. In order to sue, ur saying it's the theaters responsibility to protect ur daughter when some whaco decides to open fire. Maybe the theater should sue you for not raising a child to be prepared for some whaco to open fire at a theater. With ur line of thinking, ur just as much to blame here. And what's even more tragic, ur focused on money, instead of morning for ur daughter.

Well I'd have to say that if law abiding citizens were allowed to protect themselves, this wouldn't have happened. People like this idiot "seek out" places like this because they know that the public "trusts our law enforcement" to protect them from harm. Really!!! A police officer carries a firearm not to protect the public but to protect himself/herself from those who choose to break the law. We "the people" need to be able to protect ourselves and family members from stupid people. I will take Jeff's comment a little further. Why not sue W.B. The anti-gun idiots and politicans blame the gun manufactures for the building of the firearm. Why not? I know... lets go after the person or persons who wrote the script for the movie!!!! They're the real culprits here! Setting all the b.s. aside, go after the s***-suckers who have put ALL those gun regulations on the books to "protect" themselves from harms way not us. They don't live in the real world as do you or I. They have given us a "false" sense of security with all the laws, all the regs, all the hype of controlling "firearms" An idiot like this and those like him will "always" find a way to kill innocent people. Learn to protect yourselves. DO NOT rely on the government to protect you. Wnen you do, you WILL always end up being a statisic.

i am very sad for the families that lost family members and for the ones that was injury. i do agree that the doors need to be checked but suing the theater will not bring back her daughter or anyone that lost their lives that day .there are a lot of freaks out there in the world and we never know when they will freak out . once again i very feel bad for everyone that was there
