Victim's Mother Ready

to Sue Movie Theater

0729_james_holmes_aurora_tmzThe mother of one of James Holmes' massacre victims has hired a high-powered attorney to sue the Aurora, CO movie theater where he opened fire ... killing 12 people, and injuring 58 others.

TMZ has learned Shirley Wygal is retaining a lawyer in Los Angeles to handle her case -- and we're told she plans to go after the Century 16 Theater.

Shirley's 32-year-old daughter Rebecca Wingo was shot and killed in the theater.

Sources close to Shirley tell us she believes the theater's emergency exit doors should have been alarmed, or there should have been security guards posted next to them ... especially for a premiere as anticipated as "The Dark Knight Rises."

Witnesses say Holmes entered the theater through an emergency exit door and then started shooting. Authorities think he may have propped the door open earlier from inside the theater.

TMZ broke the story ... a survivor of the shooting spree is planning a similar suit, but he also intends to go after Warner Bros. and Holmes' doctors.

We've reached out to Cinemark -- the theater's corporate owners -- but no reply yet.

Holmes will be in court Monday morning to be formally charged in the massacre.

Shame that so many look on a tragic event like this as pay-day. is it the Cinema's fault ? How can Warner Bros be blamed. I fail to understand how one man's criminal actions can be financially borne by others. Maybe it's just me ......

Hope her case gets thrown out of court. This is f***ing disgusting but not surprising in the least. There wasn't a damn thing this theater could have really done. I've NEVER been to a theater that had alarmed exits or security guards posted at emergency exits. Ever. That's the stupidest f***ing thing ever.
The theater should counter sue her for an equally dumb reason. Say the girl should have been armed and wearing a bulletproof vest. After all, it was the premier of TDKR so she should have known better.

Greedy f***ing people trying to make money off of this. It sucks that she lost her daughter but it's ridiculous to sue anybody besides the douche that shot her. Oh, but the theater probably has a bigger bank account.

So what if the doors had been alarmed? Or there was security guards? These unarmed security guards wouldn't have been able to do anything the dozens of other people couldn't. The alarmed door would have made no difference either. This is just a cash grab. But but but...if if if ****. Nothing could have stopped this guy except heavily armed police officers.

Unfortunatly for the victims there is really nobody to sue, but thanks to some great charities and the 3 major hospitals that took patients are cutting medical cost to no money and to great charitable contributions there will be money coming in to help with bills and rehab and anything else theese people need. the people and companies of colorado are comming through for theese people and they will be taken care of by the people of colorado because that is how we treat our people just like any other city and state would do in our great nation.

This is ridiculous! I am so deeply sorry for your loss, lady. But no amount of lawsuits you file will bring your daughter back. It is most unfortunate but it is the truth. This is a mere excuse to get money out of your daughter's death and you should be ashamed of yourself! What's wrong with lawsuit happy America? Outrageous!

It's not the theaters fault, this was just an unforeseeable tragedy. The lawsuit doesn't really make sense but it is hard to make sense after something so senseless.

I don't get it. The theater is willing to pay off any funeral expenses for the victims families and the shooter will likely get the death penalty. What more can you ask? Here's an alternative outcome IMO: If Holmes barged himself into the theater through the emergency exit and the alarm went off, he will start blind firing into the crowd and the people will get up and run towards the other exits then he uses his semi-auto to fire at the panicking crowd, which his targets was in great numbers making it very easy for him, killing some people. My point is that it wont make a difference if the alarm was working or not, you cant outrun a semi-automatic or a shotgun. IMO, I think Shirley is just having a post overreaction, just let the courts handle it for the death penalty.

Anderson Cooper interviewed this woman on CNN the other day. Her crying seemed fake and she brought up the subject of money saying she wanted to clarify where funds were going. I found it really strange that she brought that up because she was asked to describe the type of person her daughter was, not what she was doing with the charity money.

I'm sorry for this woman's loss but to blame the theatre is insane and is the action of a person in terrible pain looking desperately for an outlet for her grief; but this isn't the right one. I hope the suit is thrown out.

That is just plain WRONG!!!! This theater is in my opinion ot responsable for this mans action! What do you expect? Armed security guys at all exits? TSA like security at the entrance??? If this case goes through, watch out. Cinemas might do that, and your cost of a tickert will explode. Plus - does she think moeny will bring her any solace???? I dont understand such people.

The US has got to get out of this lawsuit mentality. It ruins everything. I drove by the theater and the memorial last night. And there were probibly a couple dozen people out there paying their respects in the POURING RAIN. All of this sense of community is going to go away if everyone starts filing lawsuits and placing blame on who ever they can. It is really sad.

I think I remember seeing this woman on Anderson Cooper's show. She got interviewed with her little pomerianian dog. I sincerly feel bad for her loss. But I have never been in a movie theater that had those doors alarmed. Half the audience walks out that way in a full theater. It isn't their fault.

And I heard on the news the victims fund is putting money away for her grandkids college education. And I believe there is a seperate charity for her grandkids all together. Since she wouldn't be able to touch that money for herself, she apparently decided to go this route.

The fact that she couldn't even wait until the investigation into this guy was over to file a lawsuit, makes her look very bad. And will MOST LIKELY effect the charity for her grandkids. Because with all the individual charitys there are for the victims, I don't think many people are going to choose to donate to the one with a person suing.
