Victim's Mother Ready

to Sue Movie Theater

0729_james_holmes_aurora_tmzThe mother of one of James Holmes' massacre victims has hired a high-powered attorney to sue the Aurora, CO movie theater where he opened fire ... killing 12 people, and injuring 58 others.

TMZ has learned Shirley Wygal is retaining a lawyer in Los Angeles to handle her case -- and we're told she plans to go after the Century 16 Theater.

Shirley's 32-year-old daughter Rebecca Wingo was shot and killed in the theater.

Sources close to Shirley tell us she believes the theater's emergency exit doors should have been alarmed, or there should have been security guards posted next to them ... especially for a premiere as anticipated as "The Dark Knight Rises."

Witnesses say Holmes entered the theater through an emergency exit door and then started shooting. Authorities think he may have propped the door open earlier from inside the theater.

TMZ broke the story ... a survivor of the shooting spree is planning a similar suit, but he also intends to go after Warner Bros. and Holmes' doctors.

We've reached out to Cinemark -- the theater's corporate owners -- but no reply yet.

Holmes will be in court Monday morning to be formally charged in the massacre.

The thing is it's the lawyers who are ambulance chasing here. They see big bucks in this tragedy so they immediately reach out to these victims and families.

I understand this womans anger and wanting to sue someone for the loss of her daughter I don't think she will get much money if any. I believe there will be some changes to theater exit doors.

What a shame that people feel compelled to sue this Theater even after they've offered to pay for the funerals. How on earth could they have foreseen that a person would go to great lengths to murder people trapped in an enclosed area. They shouldn't be suing them, they should be suing the Holmes family for raising a psychotic son.

I feel terrible for all the victims and their families and extend my condolenses. This is a senseless tragedy and I guess none of us know how they are feeling unless we are in their shoes. However, I strongly feel that the only person who should be punished here is the killer himself. Not the movie theatre and not Warner Bros. Anyone could have brought a gun in through the front door and started shooting. And Warner Bros. just made a movie, of which these people wanted to see. Take the offer of the movie theatre paying the funeral and concentrate on finding justice through the justice system. Again, by condolenses to the families of the victims.

I think if they expect to be guarded by alarms, they have no business even going to the movies and the case should be dismissed with prejudice. It is just a frivolous spiteful lawsuit from bitter people looking to cash in on their own family's search for dark entertainment.

I really don't think it has anything to do with the movie at all or the theater either. They can't sue the shooter so they just go for the wealthy bystanders. That is a dirty cheap shot. If you are afraid of getting shot in public, don't go in public. Don't try to keep everyone else locked in prisoner so that if they want to use a rear exit an alarm goes off.

Going to the movies comes with a risk which they accepted when they bought the ticket. There is no implied guarantee of protection from crazed gunmen. It is a movie theater, not a prison camp.

Let the sue happy people come forward one can predict any of what happened. How many midnight premieres have occurred before this tragedy? Enough to think nothing bad would happen...

I happen to use the outside exits all the time and they are never alarmed and they are a great convenience when you want to leave quickly and not be trampled bye the rest of the people at the theater side doors. Now they want to ruin that convenience cause they lost a family member, well I say too bad, I don't feel like making you feel better by suffering for your loss.

They are mad at the world and acting crazy and that is tough on them. We don't need to adapt the whole movie theater layout just because it was the place somethign totally unrelated happened. Do they think there are going to be armed guards shooting suspects now when people go to the movies?
