Ryan Dunn Car Crash

Parents of Dead Passenger

Sue ... He Killed Our Son

8/8/2012 3:50 PM PDT BY TMZ STAFF
breaking news

The parents of the passenger who was also killed in Ryan Dunn's fatal 2011 high speed car crash are suing the "Jackass" star's estate ... claiming Dunn was extremely drunk when he wrecked his Porsche and is responsible for killing their son.

TMZ broke the story ... Dunn had been drinking HEAVILY before he crashed his Porsche into a tree at 132 mph in Pennsylvania in June 2011 ... killing himself and his passenger Zachary Hartwell.

Now, Hartwell's parents have filed a lawsuit against Dunn's estate AND the bar where Dunn had been drinking before the crash ... claiming Barnaby's West Chester was negligent in serving Dunn after he was obviously hammered.

The Hartwells also claim Dunn was reckless and negligent by operating his vehicle while under the  influence of alcohol ... and should not have been driving at extremely dangerous speeds.

Zach's parents are suing for unspecified damages ... claiming they've lost the services, guidance, and comfort of their son. And they want Dunn's estate to cover expenses associated with Zach's death ... including funeral costs.

Zach's parents are also suing on behalf of their son's estate ... claiming Dunn and the bar should pay for the "pre-impact fright, fear, pain and suffering" that Zach experienced before he died.

Zach's parents also want both parties to pay for the wages Zach would have earned during his lifetime.

i hope they don't get a single dime. Their son made a choice to get into a car with someone who was very drunk.

Ryan Dunn didn't forcefully detain this man and put in in his car against his will. If they can sue Ryan Dunn's estate than Ryan Dunn's estate should be able to sue this man's "estate" for encouragement by participation by drinking with Ryan Dunn and then encouraging him to drive intoxicated. Let's go even further by integrating the possibility that this passenger participated in the cause of the accident by telling Ryan Dunn to go faster in that car. Give me a break.

Perhaps Zac's parents should be sued for allowing the Jack Ass star for driving drunk ..... if Zac hadn't let the dude drive drunk, he wouldn't be dead.

Will they also sue their son's estate, charging that he caused his death by getting into a car (duh!) with a hopelessly impaired driver (er, close friend)....MORONS! Someone should sue them for frivolous litigation. Disgusting. Everyone is soooo lucky other drivers/pedestrians/cyclists/dogs/cows/deer were not killed when that fetus got behind the wheel. I'd like to sue these people for the annoyance they are causing me.

Not right that they are able to sue for the wages he would make during his lifetime. Any wages he would have made would have been to support himself, not his parents. They are being greedy!!!

I can't imagine the pain this man's family experienced after losing their son but there is a serious flaw in their thinking. Their child got in a car with a drink driver knowing the risks just like Dunn got behind the wheel knowing the risks. It's time we stop just focusing on the drivers and focus on the passengers as well. If you're with a friend who is drunk, take your friends keys. If you can't - and I'm not kidding here - call the cops. You could save someone's life.

Why sue a year later? Honestly though...

This is just plain greedy! You're not doing this for your son you're doing it for yourself, really you want to recover funeral bills??!!! How selfish to bring these souls through the dirt, let them rest in peace! There is no place for greed in friendships and family, this was clearly an accident and both paid the ultimate cost for each of their indiscretions! I want to sue you for making me read this again!

Sue for what he would have earned in a lifetime? How do you determine that?

Friends don't let friends drive drunk. & they certainly don't ride shotgun in a car the size of a Tonka toy doing over 100 mph. Sounds negligent to me. Something i would have done in my teens when i first started driving. I'm sorry to say it but it has always been my opinion that the Ryan Dunn is a murderer for being 100% responsible for the accident that took both these mens lives. Mr. Hartwell is equally responsible for the accident as I'm sure he thought driving like a maniac was a good ole time. I'm also sure that they were practically family to everyone who worked in that bar. Thankfully no one else way killed but to sue the bar seems like a money grab. Shouldn't the insurance on the car & any life insurance policies have been enough? RIP

they want the wages he would have expected during his lifetime? A bit presumptuous - do we ever know how long we are going to live?

So everyone is supposed to "babysit" drunks and no one takes responsibility for their own actions. yeah right

primary assumption of risk when the passenger entered the vehicle knowing the driver was drunk.

It was only a matter of time. But, remember......friends don't let friend drive drunk, and don't get in a car with someone that intoxicated. Very, very sad situation all around.

So their son basically killed himself and the parents are suing other people? Blatant gold diggers, trying to cash in on their son's recklessness, just pathetic.
