Sue ... He Killed Our Son

The parents of the passenger who was also killed in Ryan Dunn's fatal 2011 high speed car crash are suing the "Jackass" star's estate ... claiming Dunn was extremely drunk when he wrecked his Porsche and is responsible for killing their son.

TMZ broke the story ... Dunn had been drinking HEAVILY before he crashed his Porsche into a tree at 132 mph in Pennsylvania in June 2011 ... killing himself and his passenger Zachary Hartwell.

Now, Hartwell's parents have filed a lawsuit against Dunn's estate AND the bar where Dunn had been drinking before the crash ... claiming Barnaby's West Chester was negligent in serving Dunn after he was obviously hammered.

The Hartwells also claim Dunn was reckless and negligent by operating his vehicle while under the  influence of alcohol ... and should not have been driving at extremely dangerous speeds.

Zach's parents are suing for unspecified damages ... claiming they've lost the services, guidance, and comfort of their son. And they want Dunn's estate to cover expenses associated with Zach's death ... including funeral costs.

Zach's parents are also suing on behalf of their son's estate ... claiming Dunn and the bar should pay for the "pre-impact fright, fear, pain and suffering" that Zach experienced before he died.

Zach's parents also want both parties to pay for the wages Zach would have earned during his lifetime.

Your son was irresponsible for getting into a car in which the driver was drunk. Your son doesn't deserve compensation for being an idiot, sorry!

Was Zach forced against his will to be Dunn's passenger? Nope. He chose to be there. Ryan Dunn's family is hurting as well. Why bring them any further grief? Any amount of money won't make the situation better. They'll be wealthier but still without their son.

I can not imagine the pain of loosing your son but no amount of money will ever bring him back or ease your pain. I understand requesting the estate pay for his funeral bills. However, he voluntarily got into that car with someone he knew was drunk. The bar, bartendar, and server should be fined for overserving their customer, but liable for him driving like a maniac and going out of control, I don't think so. The bar did not make him get into that car and drive like an idiot. You are suing for his pain and suffering in the moments before the crash? How do you know he was awake or felt anything at all. There is no proof of this, therefore baseless. And his lifetime wages? Give me a break, how is one to know how long he would have lived? and its not like he was going to be living home with mom and dad and handing over every red cent. Common sence and personal responsiblity seem to go by the wayside in these ridiculous lawsuits. The attorney that filed this should be ashamed of themselves for wasting precious court time. I'm sure the estate will pay them off to go away. It comes down to extortion

WOW! The parents should realize that it was theirs son choice to get in the card with him. I bet he was drunk also. I bet the parents are broke and are just looking for a pay out. Whats has America become. No one wants to work for there own income instead they rather sue, sue and sue. There son should had been responsible and said I am not going to get in a car with someone drunk, though he was probably drunk as well.

Wait, was this guy forced to get into the car at gunpoint? Or did he make a choice to get in a car with a drunk driver? Why should someone else be responsible for the guy's choices?

I can see how they see it that way...but they were probably laughing their asses off until they missed the freeway turn off and hit a tree instead. Still, Dunn was driving and they should get some of his estate.

" Uh, he, also drunk going what was it? like 130 mph i think they determined?? I don't think he felt anything. And Zach did get into the car under his own will. I feel they'r ejust trying to get money they dont even need here.

BUT, I guess their son bore NO responsibility for getting in the car w/someone who was wasted. Hope they don't get a one red cent. People like them who sue, blaming EVERYONE else, make me fu**ing sick!

I'm pretty sure that will be one huge thing working against them, publicly saying they wouldn't sue, the reason why, etc., now all of a sudden they're out for blood. No amount of money will bring back Ryan or Zach, so the healthiest thing they can all do is move on from this nightmare and remember the good times they had with their son.
