Sue ... He Killed Our Son

The parents of the passenger who was also killed in Ryan Dunn's fatal 2011 high speed car crash are suing the "Jackass" star's estate ... claiming Dunn was extremely drunk when he wrecked his Porsche and is responsible for killing their son.

TMZ broke the story ... Dunn had been drinking HEAVILY before he crashed his Porsche into a tree at 132 mph in Pennsylvania in June 2011 ... killing himself and his passenger Zachary Hartwell.

Now, Hartwell's parents have filed a lawsuit against Dunn's estate AND the bar where Dunn had been drinking before the crash ... claiming Barnaby's West Chester was negligent in serving Dunn after he was obviously hammered.

The Hartwells also claim Dunn was reckless and negligent by operating his vehicle while under the  influence of alcohol ... and should not have been driving at extremely dangerous speeds.

Zach's parents are suing for unspecified damages ... claiming they've lost the services, guidance, and comfort of their son. And they want Dunn's estate to cover expenses associated with Zach's death ... including funeral costs.

Zach's parents are also suing on behalf of their son's estate ... claiming Dunn and the bar should pay for the "pre-impact fright, fear, pain and suffering" that Zach experienced before he died.

Zach's parents also want both parties to pay for the wages Zach would have earned during his lifetime.

Zach hated his family, they weren't even invited to his wedding. They are just after the money.
They had to take his wife to court to remove her as head of his estate because she wouldn't go along with this.... they are a disgrace.

sue sue sue sue sue all people do anymore is go get an attorney. attorneys did a great job of making sure we need them. i really do not think that this is the right thing to do. #1 the friend went on his own & he assumed the risk.

Looks like they are just looking for some money. Doubt money is going to make them feel better but maybe can set them up. Profiting off your sons death is disgusting! Their son chose to get in the car so he is to blame! Shame on the parents for trying to get cash and blame others for their sons mistake!

Unfortunately in todays society you can sue for anything. It is a horrible situation all around but in the end they will get money.
In PA you can sue the bar and even the individual bartenders that served them. There was a bar in the area (I live in West Chester) that had a patron that caused an accident and they ended up paying so much that they went out of business.
In a lawsuit like this they are going to put on every charge possible and then it will be hammered out and a settlement will result. Just like your typical criminal trial, you begin with the maximum charges in order for some to stick and others be thrown out. It is all about leverage in figuring the final payday.
No matter what they were both adults and both responsible for what ended tragically and unfortunately the family will end up with some money but will still be just as sad in the end.
It's a no win situation and seeing as the lawyer is from Philly it's not surprising. A philly lawyer will sue for any and everything.

I'm interested to know what the son's blood alcohol level was at the time of the crash. I feel compassion for the parents over losing their son, but the son made a choice to get into a car with a drunk person.

Bull**** their son was drinking too and I saw it in the pictures. he was with Dunn clearly seeing that he had been drinking and let him drive and still got in the car with him on his own free will. no one forced him, he knew what he was doing. Sorry for their loss but they are looking for a payday and calling someone a killer when he didn't mean too and their son willingly drank, let Dunn be the driver and got in the car with him. Dunn was known for these things, there was no way that he couldn't have know after being his friend for so many years...

Let's remember there are two boys and two families and the extended Jackass family. It's sad that society expects and accepts people to sue over every tradgic incident nowadays. Future earnings is impossible to calculate, so it is all based on assumption. I would agree with paying for funeral expense and I am sure that would be justified by the estate. But to rake the estate over the coals when Ryan lost his life AND the same bar where Zach was also being served and made his own decision to get into the car with Ryan....the family needs to be careful in getting caught up in the lawyers speak. Trust me when I say he has the eye on the "prize" as well. The family must think for themselves in reasonable terms and not with fairytale riches. This lawsuits will cause both families continued heartache and unbelievable amounts of stress for a long time and these types of matters do not resolve quickly and could last years. It's a real shame on all ends of the spectrum.

It's lawsuits like this that make me want to puke. Clearly this is a some reach from a law firm to grab money from a completely unassociated company like the "Jackass Estate." The accident was horrific, and unfortunate, but it takes two people to get into a car with a drunk driver. As long as kids think drinking makes them grown up, they'll continue to play roulette with their lives, and all the parents of the kids who weren't driving are going to pretend they raised their kids right, and that it was the single act of a single individual that caused their law abiding child to die unexpectedly. Everyone is playing this game. Don't like it? Raise your ****ing kid to know better.

Sorry I'm calling this bull crap and here is why. Hartwell was drunk as well........they were both wrong . The parents IMO are looking for a money grab and the key clue pointing to this is them wanting the money he would have made over his lifetime.......we're they getting that money if there son was alive...no s why should they get it now.

They should sue the bar but otherwise since there son was as drunk as Dunn I say that's it they were both waisted
