Sue ... He Killed Our Son

The parents of the passenger who was also killed in Ryan Dunn's fatal 2011 high speed car crash are suing the "Jackass" star's estate ... claiming Dunn was extremely drunk when he wrecked his Porsche and is responsible for killing their son.

TMZ broke the story ... Dunn had been drinking HEAVILY before he crashed his Porsche into a tree at 132 mph in Pennsylvania in June 2011 ... killing himself and his passenger Zachary Hartwell.

Now, Hartwell's parents have filed a lawsuit against Dunn's estate AND the bar where Dunn had been drinking before the crash ... claiming Barnaby's West Chester was negligent in serving Dunn after he was obviously hammered.

The Hartwells also claim Dunn was reckless and negligent by operating his vehicle while under the  influence of alcohol ... and should not have been driving at extremely dangerous speeds.

Zach's parents are suing for unspecified damages ... claiming they've lost the services, guidance, and comfort of their son. And they want Dunn's estate to cover expenses associated with Zach's death ... including funeral costs.

Zach's parents are also suing on behalf of their son's estate ... claiming Dunn and the bar should pay for the "pre-impact fright, fear, pain and suffering" that Zach experienced before he died.

Zach's parents also want both parties to pay for the wages Zach would have earned during his lifetime.

if dunn had lived, they'd have somewhere to place the blame..
but as it is, theres no where to point any fingers.

if hulk hogan's kid can turn someone into a vegetable and not be held accountable. why does that bar owe anyone anything?

this is retarded how are you gonna sue someone who is not only passed but wait so long too, im feel for their lost but come on "should pay for the "pre-impact fright, fear, pain and suffering" that Zach experienced before he died." that is ridiculious.... yes maybe he should be responsible for the funeral cost but all that other stuff is dumb... and why wait so long to file a lawsuit ... what has this world come too that people feel they need to sue for everything..... not just this particular lawsuit but all the other ones too

I had a good friend that recently died in a car accident. The driver was his friend and was very drunk, and he also died. It was horribly sad and terrible to see the family go through the loss. However, they didn't once think about suing the driver's family. They both got in the car by their own choice; nobody was forced. And if my friend would see his family suing his friend, he'd be pissed and tell them to knock it off. Stop being greedy. Find a different way to grieve than lashing out.

A lot of ppl. sue for funeral costs and the loss of affection etc., but these ones lost me at the fright and pain before/during the accident and ALL the lifetime earnings of the guy????? Like talk about milking something for all they can and thats going way overboard.....The guy made the chopice to get in the car.

Why in the F. should they get any money from Dunn's state? The passenger made the choice to get in the car, he too had been drinking. If he was such a responsible young man he wouldn't have gotten in the car. The whole lawsuit is bullcrap.

I can understand this all being very horrible but it sounds to me that they are really in need of some quick cash... and a lot of it...

It's a tough situation but in the end it was his choice to get in the car with him, as well as their other friends job to stop him from driving that night.

Its a sad and horrible situation but their son was a grown man with every right to say that he would not get in the car.. To profit off their sons death is greedy and cold.

Dunn had a problem with drinking and driving. This wasn't his first car crash but it seems like his parents and his friends let him keep it up. Part of me says that I hope they get most of his estate so it sends the message to these other Jackasses that if you continue to be irresponsible, you are risking everything you've made.
