Sue ... He Killed Our Son

The parents of the passenger who was also killed in Ryan Dunn's fatal 2011 high speed car crash are suing the "Jackass" star's estate ... claiming Dunn was extremely drunk when he wrecked his Porsche and is responsible for killing their son.

TMZ broke the story ... Dunn had been drinking HEAVILY before he crashed his Porsche into a tree at 132 mph in Pennsylvania in June 2011 ... killing himself and his passenger Zachary Hartwell.

Now, Hartwell's parents have filed a lawsuit against Dunn's estate AND the bar where Dunn had been drinking before the crash ... claiming Barnaby's West Chester was negligent in serving Dunn after he was obviously hammered.

The Hartwells also claim Dunn was reckless and negligent by operating his vehicle while under the  influence of alcohol ... and should not have been driving at extremely dangerous speeds.

Zach's parents are suing for unspecified damages ... claiming they've lost the services, guidance, and comfort of their son. And they want Dunn's estate to cover expenses associated with Zach's death ... including funeral costs.

Zach's parents are also suing on behalf of their son's estate ... claiming Dunn and the bar should pay for the "pre-impact fright, fear, pain and suffering" that Zach experienced before he died.

Zach's parents also want both parties to pay for the wages Zach would have earned during his lifetime.

i think his parents are just being plain greedy at this point. its been over a year since this happened and both of the guys were drinking all night at the bar. while ryan shouldnt have been driving, zach made the choice to get into the car with him and probably didnt think about anything else. if hes friends with ryan chances are hes a similar person who likes a thrill and maybe driving that fast was fun to them at the time and they werent thinking about the deadly consequences they would have to pay. its what alcohol does to you, it clouds your judgement.

i get his parents are grieving, but im sure ryans parents and bam's parents and ryans wife (or girlfriend, though i think he married her), bam especially are grieving just as much as they are and this is only going to cause more pain for all parties involved.

what a bunch of bs... sorry for the loss but the parents are obviously money hungry... the judge should ok the lawsuit only if the parents give all the money to a charity and not live rich of the money....

This case is a slam dunk and won't even see a court room. This will get settled for tons of money. The fact that he was drunk to will have ZERO impact. Dunn was driving at 132 MPH. Even if they were both sober this case would be a slam dunk. It isn't greed on the parents part...it's stupidity on Dunn's and he is responsible even in death (financially) for his actions which were wreckless and caused a wrongful death.

Sorry, but IMO, their son was drunk too, and showed equally poor judgement in climbing into a car with him, so he chose his path.

While I'm sorry for your loss, your son made the decision to get in the car. If he was sober and knew the driver was drunk & he still got in the car, it's his fault for making a bad decision. If he was too drunk to know the driver was drunk & he still got in the car, it's still his fault. Don't blame someone else for your son's decisions. Suing won't bring him back!

What happened was definitely a tragedy... but Zach's parents filing this lawsuit is just wrong!! No one forced Zach to get into the car with Dunn... it was his CHOICE... and it was a poor choice. I'm sure they're hurting over the loss of their child but Dunn's parents are hurting too. Besides, Dunn's insurance should've already paid for Zach's funeral expenses so that's moot now.

The friend drank just as much and was probably passed out at the time of the crash so probably did not feel a thing.

Hey Barnaby's!!! THAT's why your being sued.....like I said a year ago:

The bartenders need to learn to stop serving alcohol to drunks. I've seen this many times there. The twitter picture of Ryan Dunn was taken TWO hours BEFORE he left the bar, he was clearly drunk, glassy eyes, red flushed face. He drank at least 6 drinks there shots included, they should have never let him drive and at the VERY LEAST STOP SERVING him. Shame on them.
