Sue ... He Killed Our Son

The parents of the passenger who was also killed in Ryan Dunn's fatal 2011 high speed car crash are suing the "Jackass" star's estate ... claiming Dunn was extremely drunk when he wrecked his Porsche and is responsible for killing their son.

TMZ broke the story ... Dunn had been drinking HEAVILY before he crashed his Porsche into a tree at 132 mph in Pennsylvania in June 2011 ... killing himself and his passenger Zachary Hartwell.

Now, Hartwell's parents have filed a lawsuit against Dunn's estate AND the bar where Dunn had been drinking before the crash ... claiming Barnaby's West Chester was negligent in serving Dunn after he was obviously hammered.

The Hartwells also claim Dunn was reckless and negligent by operating his vehicle while under the  influence of alcohol ... and should not have been driving at extremely dangerous speeds.

Zach's parents are suing for unspecified damages ... claiming they've lost the services, guidance, and comfort of their son. And they want Dunn's estate to cover expenses associated with Zach's death ... including funeral costs.

Zach's parents are also suing on behalf of their son's estate ... claiming Dunn and the bar should pay for the "pre-impact fright, fear, pain and suffering" that Zach experienced before he died.

Zach's parents also want both parties to pay for the wages Zach would have earned during his lifetime.

I look at it this way, Zach was not forced into the car with ryan, it was his decision. I'm sure he knows that, so why sue? It was Zachs decision.

i don't get how they can sue for wages for their son's life? there are a lot of what ifs? in this scenario. What if he killed himself in his own drunk driving accident that following year? what if he got struck by lightning? there are just too many scenarios that could have happened. From the crowd he hung around, it doesn't sound like he made wise decisions. They are known for doing stupid stunts [i do like the jack ass movies] and for living over the edge. They should be happy if they get funeral costs. While it is sad that this is the way their son perished, ultimately, he chose to get drunk and get in a car with someone who is known to be reckless.

Are you kidden me??? Zach was an adult and he knew full well that Dunn was drunk and should NOT have been tdriving and he STILL got in the car with him. Believe me, it was a tragic way to die and my heart goes out to all the families involved, but he was not kidnapped and forced to get into that car...HE GOT IN ON HIS OWN.

Sorry but if I knowingly got in a car with a friend who was drunk, I would be just as much as to blame for getting into the car. What ever happened to the "friends don't let friends drive drunk"? I'm sorry for their loss but their son had the choice to get in the car or not. I wouldn't want my family to go after the driver when we both made stupid mistakes. Example, in high school a friend crashed into a pole killing her passenger. The passengers family didn't want to pursue charges because they knew, their daughter was also to blame for getting into the car when they both were intoxicated.

He had a well known reputation among his friends as a drunk and as bad driver. Anyone who was stupid enough to get in a car with him was either a moron or had a death wish.

It's very sad their son lost his life....however he made the choice to get in a car with someone who was drunk. They should not sue because their son also made a bad choice. The ignorance of people today.

They should pay for Zach's potential wages? For all they know, he would have been fired 3 days later. It took them a year to file this lawsuit. They are just after the money, wanting to live off of their son's suffering.
No one should pay for potential wages that he could have earned.
How do they know what Zach felt prior to the impact? He may have been passed out in the passenger's seat. He couldn't feel fear. He probably couldn't feel his own legs he was so drunk.

Dunn made a awful decision when he decided to drive drunk that day. The son made an awful decision when he decided to jump in passenger seat that day. How about you sue your dead son's estate for the pain, and suffering his awful decision caused you while your at it. I'm sure you can win at least a little bit of cash from one of the lawsuits.

nobody put a gun to the son's head and told him to get in the car. Obviously, the son knew that Ryan was drunk. so why not call a cab?

REALLY??? Who held the gun to this guys head to get the the car with a drunk person or to get drunk himself? People need to take responsibility for their own stupid actions and their families need to deal with it! They are all grown adults and are responisbility for their stupid actions!

I TOTALLY understand funeral costs, and a decent amount for damages, but his WAGES FOR LIFE????? Seriously? That is unrealistic. His parents wouldn't have been given 100% of his earnings anyway. And the fear he had pre impact? There's no way to prove any of that. They were BOTH drunk beyond recognition. Besides, "pain and suffering" usually goes to the person who was hurt, not their greedy family. I am very sorry for both families and hope some peace can be brought to them, without TOO many $$$$$$$ clouding the picture.
