Over Topless Pics

Kate Middleton and Prince William have declared war on the French magazine that published naked photos of the future Queen of England -- filing a lawsuit today against the publication.

A rep for St. James's Palace released a statement saying that "legal proceedings for breach of privacy have been commenced today in France" by the royal couple.

So far, it's unclear what relief they are seeking.

As we reported, the family had threatened legal action over the topless photos published today by France's Closer magazine, showing a topless Kate on vacation with Prince William recently.

Now, they've made good on their word.

Moments after the pic went public, the Royal Family issued a statement, claiming, "Their royal highnesses have been hugely saddened to learn that a French publication and a photographer have invaded their privacy in such a grotesque and totally unjustifiable manner."

For the magazine's part -- Closer's editor Laurence Pieau has spoken out, calling the media "hypocritical" for condemning her decision to run the pictures.

TMZ, you need to learn an important lesson. There is no Queen of England. The separate English realm ended in 1707 under the Act of Union, when England and Scotland united to form the UNITED KINGDOM.
The couple are the future King and Queen Consort of the UNITED KINGDOM OF GREAT BRITAIN and NORTHERN IRELAND along with 15 other Commonwealth realms. Be intelligent and start using PROPER, CORRECT terms!

The editor of Closer needs to take a look at what happened to Paris Match. Both Princess Caroline of Monaco and Sarah, Duchess of York sued the publication and WON. There are LIMITS.

To all of you who say that Kate will "never become Queen"... that isn't exactly true. Kate will be known as the Queen while William is King. The reason that Prince Phillip is not "King" is because of his gender. The same rule does not apply to the title of Queen. However, if William steps down from the throne, or dies while in power, and one of his children becomes King or Queen, Kate will step down as Queen, and be known as the "Queen Mother". This is what happened with Queen Elizabeth's mother (who was known as the Queen when her husband was King), and the same thing will happen with Kate.

This pictures were taking when they were in a PRIVATE property. Kate topless photo has broken French privacy laws. The French rights are absolute and enshrined in the country's constitution. They ban not only the disclosure of a person's private life but also forbid the "theft of personal image", which technically bans paparazzi taking photos even in public places. French Closer magazine has breached the privacy of the Duke and Duchess of Cambridge and could face prosecution under criminal law for "fixing, recording or transmitting the image of a person in a private place without their consent". The maximum sanction is imprisonment and a €45,000 fine.

I'm not familiar with the laws that regulate stalkers and the paps in France, but I seriously doubt Closer would have published these pictures, if they were obtained illegally. Common sense should have told both William and Kate that "PAPS ARE EVERYWHERE" and they will go to "ANY LENGTH" to get "MONEY SHOTS"!!! In all fairness, they should just say, "OUR BAD" and LET IT GO!!! They weren't in the U.K. where the press respects their titles nor were they traveling in France in any official capacity. Letting it "ALL HANG OUT" outdoors within range of a pap's camera lens was just "PLAIN STUPID" on their part.

Nothing embarrassing, however, she neglects to mention it was a gross invasion of privacy. As an editor of a major publication, she would know the rules. The laws there are very strict when it comes to privacy laws.

I think it was to get people talking about the magazine more than anything. She should, and will be prosecuted for her actions.
