Judge Will REVOKE Probation

Lindsay Lohan is about to have her probation revoked ... TMZ has learned.

We broke the story ... Lindsay will be charged with the criminal offense of lying to a police officer.  As you recall, she told Santa Monica cops she was not driving her Porsche last June when it slammed into an 18-wheeler on Pacific Coast Highway. Fact is, she was -- and lying to cops is a crime.

Sources connected with the case tell TMZ ... when the Santa Monica City Attorney files the criminal case against Lindsay, it will go to L.A. County Superior Court Judge Jane Godfrey for arraignment. At the time Lindsay is arraigned, we're told Judge Godfrey will revoke Lindsay's probation and set the matter for a full hearing, on grounds she violated her probation in the jewelry case by breaking the law.

In case you're wondering, the judge who handled the jewelry case, Stephanie Sautner, will not be involved in the probation violation case. Once Lindsay was sentenced, the probation case gets sent to whatever judge is hearing the next criminal case against LiLo.

We're told the criminal case will be filed soon.

I'm not sure how being sorry about this is going to get her off; as being in an accident is not a crime; lying to the police is and if she was in shock they would not of released her an hour later I don't care what she told them; hospitals have to protect you from yourself if you are not able to do so and being in shock is one of those times.

They will wait til after Sun, when her so called movie flops. She will want to go to jail to avoid the embarrassment of the numbers from the movie.

That sounds GREAT, but when will these charges be filed? They better hurry up, because I believe her probation ends in May 2014, and we all know how long these court proceedings can take!

Whether it is extended or revoked, my guess is she will either get house arrest with an ankle monitor or rehab. But who knows? If she is convicted of lying to police, maybe the Judge will finally lock her up?

funny thing is that they keep her in the "mersa" wing with all the street rats that have abceses and staff infections. This is where they isolate people in their own cells and it is right next to the high power and solitary. An attorney I know had a client in with her. His client was put there for lice and they have seperate cells and are not let out til they are "non-contagious"

Wouldn't the date for jail time calculation on a PV go back to the date the new crime was committed, and not when charges were filed?

Again, this new judge or commissioner will uphold Sautner's sentence, meaning she will be sentenced to jail for the 300 days on the violation alone. The new charge, HOPEFULLY, will have consequences in addition as well . . .
