Lindsay Lohan Judge

Not Big

On Jail

12/12/2012 7:02 AM PST BY TMZ STAFF

1212_godfrey_lohan_tmzLindsay Lohan may have done it again ... dodged a jail bullet by the luck of the judicial draw.
We broke the story ... Lindsay will be arraigned today on 3 criminal charges -- including lying to cops -- in connection with her car accident on Pacific Coast Highway last June.  We know the judge who will arraign her -- Commissioner Jane Godfrey -- will formally revoke her probation during the hearing.  As you know, she's on probation for the jewelry heist case.
The Commissioner will order a formal hearing, and if the evidence shows it's more likely than not that LiLo committed a crime, the Commish could send her to jail for as long as 245 days.

Now the good news for Lindsay.  One source very familiar with the Commish tells TMZ ... "Godfrey is not a big jail person."

Get this ... Commissioner Godfrey presides over Drug Court, in which she hears case after case involving people with serious drug cases.  Godfrey strongly favors counseling over jail, to the point she has a graduation ceremony for people who complete the program and digs into her own pocket to buy little gifts for the graduates ... like Starbucks cards.

And the Commish presides over Homeless Court ... where she deals with homeless people who have committed crimes and gets them help to rehabilitate them, instead of throwing them in jail.

Maybe Godfrey could start Night Club Court.  She does have the perfect defendant.

Geeez. Its county fvckin jail. When u get there u see the sorting hat. If you want to work u work. If you want gen pop u go there. If u work u choose the kitchen or the maintenance crew. If you choose maintenance you sit on your ass alot, but you get clean clothes each time you work easy shifts of sweeping, handing out meals, or stuff like working the inmates belongings closet. If you choose kitchen you work six days a week, eat well, and change clothes every day. If u are in gen pop u sit on your ass and stay in your cell 22 hours per day. You get clothes once or twice a week and you get 3 pairs of undies socks and bras. In working pods you are in a dorm setting where you can hang out and make friends but are still locked down to bunks many hours per day...if you work time goes by.

Girls hook up but no one forces anyone, there are some so called "jumping offs" that the different clans try to perpetrate from time to time, and they have beefs with each other, but the women mostly get along and are NOT segregated.. Guards are not fvcking anyone. Every move that is made is surveilled 24/7 at check point stations.

If you are there for a period of time ybackou can take classes on certain thins, if you want to see a nurse it is now a requirement that you are seen within a few days. You can order food, snacks, water and hair remover etc. once a week.

If you are going to county jail you do no cry about it you go there and do your time because you put yourself there.

Lohan has not had to be brought to court from lock up or spend any significant time there so its her turn to try it out and see if she wants to keep going back. She has it easy in the isolation because there are so few people that they are not locked down as much and get changes of clothes every two days and showers every day as do workers but g pop can wait days for showers.

If she wants to steal and hit people in rage and drink and drive and wrecklessly drive cars under the influence of drugs...she must think in her mind, each time she wants to haul off and hit someone, is it worth it and if I do this I may go to jail and THEN I CANNOT CRY ABOUT IT I MADE THIS CHOICE.

She could definitely be one to get in a fight there because she is not cool people. But, she gives as good as she gets so she does not deserve any worry

Zombie Whitney Houston

As if there was ever a chance in hell Lindsay was going to do any time anyway. The Southern California legal system is a joke when it comes to celebrities.. even D-list ones like Lindsay. She could walk into a police station and murder somebody and she'd get little more than a slap in the wrist. This lying druggie thieving whore will never go to jail for any substantial period of time. She'll OD before that happens.

Celebs behaving badly

Believe me if she gets Drug Court, it is way worse than doing 60 days in jail. You report and test daily and it goes on for 9 months and sometimes 2 years. You are required to spend the first 90 days in rehab lockdown ahile you test and go to counseling and AA meetings all day long.

I hope she gets Drug Court I will laugh so hard because it wil go on forever with this hope to die addict and she will go to jail anyway

The thing that TMZ (instigators) seemed to have left out is that people who go to Drug Court have to do their time first. It is part of sentencing. In the case of a repeat offender she will not get just drug court. Especially because this is technically not a drug related offense unless Liho *****s out and says "oooh I did it cause I was high" then it may be considered as a diversionary sentence.

At least in LA she has to post bail. In NYC she is arrested twice and just walks out the door.

Drug Court brings addiction recovery techniques to non-violent, first and second time offenders - with effective, long-term results.
Drug Court serves as a voluntary alternative to jail time for non-violent drug offenders. Clients enter Drug Court through the court system or via attorney referral, and embark on a rigorous one-year treatment and counseling program that includes daily drug testing. Drug Court clients participate in a three-tiered recovery and counseling program that involves:

Detoxification and stabilization
Daily maintenance of sobriety
Addressing recovery-related obstacles (Educational training and employment)
Drug Court clients attend 12-step meetings and personal and group counseling sessions, and report their progress to the courts on a regular basis. The clients are able to establish a rapport and relationship with the judge. Clients who successfully complete the treatment program have their cases dismissed by the courts. This takes place during a graduation ceremony, which is a time of great celebration and joy for the clients, and their families and friends.
