1212_godfrey_lohan_tmzLindsay Lohan may have done it again ... dodged a jail bullet by the luck of the judicial draw.
We broke the story ... Lindsay will be arraigned today on 3 criminal charges -- including lying to cops -- in connection with her car accident on Pacific Coast Highway last June.  We know the judge who will arraign her -- Commissioner Jane Godfrey -- will formally revoke her probation during the hearing.  As you know, she's on probation for the jewelry heist case.
The Commissioner will order a formal hearing, and if the evidence shows it's more likely than not that LiLo committed a crime, the Commish could send her to jail for as long as 245 days.

Now the good news for Lindsay.  One source very familiar with the Commish tells TMZ ... "Godfrey is not a big jail person." 

Get this ... Commissioner Godfrey presides over Drug Court, in which she hears case after case involving people with serious drug cases.  Godfrey strongly favors counseling over jail, to the point she has a graduation ceremony for people who complete the program and digs into her own pocket to buy little gifts for the graduates ... like Starbucks cards.

And the Commish presides over Homeless Court ... where she deals with homeless people who have committed crimes and gets them help to rehabilitate them, instead of throwing them in jail.

Maybe Godfrey could start Night Club Court.  She does have the perfect defendant.

The judge would be doing more harm than good by having Lindsay do a therapeutic group type of requirement. She NEEDS to be put into general population (for now), and be shown what happens when you constantly screw up.

So once again no jail for her. Isn't that nice for her. I just hope she doesn't kill anyone with her car next time, or it will be on all these judges. Going easy on her is not going to help her as already proven and may hurt others as well

of course, instead of going to jail like the rest of us world if we even did one of the many things she has done-she is going to get a little gift for working so hard on her self. no wonder she doesn't she take life seriously, no one treats her seriously.

Commissioner Ronald J. Gilbert who presides over West Valley Drug Court in Rancho Cucamonga, CA is who really pioneered such practices. If you ever wanna have a moving experience, show up at the courthouse at 10am on any Friday, and sit in....Dept. R1 (first floor). I guarantee an experience more uplifting than any church ceremony....

Another do-gooder LA Judge that never solves the real reason why people commit crimes -- they are never punished properly. I can see the writing on the wall now - Lindsay will not be punished - again. Too bad the LA Courts have people like this in the system as Offenders just commit crimes over and over and are never punished. I feel sorry for the Prosecutors who work hard to put people away and nothing happens.

Of course she doesn't want to actually punish her for breaking the law. Celebs are above regular people. Laws don't apply to them in the same way I guess.

I'm gonna repeat and simplify. Drug Court is harder than county jail. You are locked down for 90 days doing classes and AA meetings all day and then you continue daily AA meetings and drug test daily at drug court. Only 40% complete this program in the year it takes. It's like the "come on back and see us" sentence

Plus she does not qualify in these cases
