An official from the D.C. police told a member of the Federal Bureau of Alcohol, Tobacco, Firearms and Explosives that David Gregory COULD display a high capacity magazine on "Meet the Press" Sunday ... TMZ has learned.

Well-placed law enforcement sources tell TMZ ... a staffer from "Meet the Press" called ATF before the show aired to inquire about the legality of David holding the empty magazine during a segment on gun control.  We're told the ATF person contacted the D.C. police to find out if the District of Columbia -- the place where the show is broadcast -- had a law prohibiting such a display. 

Our sources say the D.C. police official informed ATF David could legally show the magazine, provided it was empty.  An ATF official then called the staffer from "Meet the Press" to inform them they could use the magazine.

D.C. police released a statement today, saying "NBC contacted the Metropolitan Police Dept. inquiring if they could utilize a high capacity magazine for this segment.  NBC was informed that possession of a high capacity magazine is not permissible and the request was denied."

It appears "Meet the Press" may have gotten 2 different answers from law enforcement.

David is currently being investigated for displaying the magazine.

This is a classic example of how our justice system works. Because he's in politics and part of the media, "They're looking into it."

If he was just an average citizen, he woud have already been arrested.

And if he happened to be black he'd already be doing a dime in D block at Leavenworth.

As law-abiding citizens we are expected to navigate the labyrinth of conflicting state laws regarding firearms and we do successfully everyday. Although many of these laws don’t seem to make sense to firearm owners we still respect them and abide by them everyday.

TMZ, quit covering for the hypocrisy!! It is illegal to own a high-capacity magazine in DC. Doesn't matter what ATF may have said, DC is the local authority.
The point is that Gregory (and apparently you) think that there is some way around the "Equal Protection" clause. You think that some purposes for obeying the law are different than others.

If you think it is silly for Gregory to be prosecuted for having a high-capacity mag, good. Then it's silly for anyone else. A metal box, plastic and a spring do not make a threat. Neither does a law-abiding citizen with an AR15!!!

If you want to protect Gregory, then argue that the Second Amendment is our carry permit. Anything else is simple tomfoolery!!!!
