rang in 2013 pretty hard ... getting popped for public intoxication on New Year's Day ... TMZ has learned.

Law enforcement sources tell TMZ ... Brolin was arrested just before midnight on January 1 in Santa Monica. Brolin was booked into jail at 3:02 AM and then released at 7:14 AM.

Brolin was not given a citation for the arrest -- meaning he will not have to go to court over the incident and it is completely over.

Sources close to Brolin tell TMZ he was hanging out with a bunch of his guy friends that night and ended up having "too much fun."

A Big thanks to the Soviet Republic of Santa Monica. How is it that he was arrested just before midnight New Years Eve and he's booked at 3 am? They should have just called him a cab.

I don't understand this public intoxication. Must be a way of making money for the state. If a county serves alcohol. You have to get from point A to point B. I can understand if it was a dry county but sometime after doing business one has to go out in public

Josh Brolin got busted for public intoxication and spent four hours in the drunk tank. In Virginia, public intoxication is a class 4 misdemeanor and is punishable up to a $250 fine. Although jail time is not an option, something like this may not look good on your record as you apply for jobs and professional licenses.
