Woman Says 'Glee' Star Forced Sex Without Condom

Salling's publicist, Janice Lee, tells TMZ ... "There is no truth to this. It's the textbook case of a disgruntled girl looking to cash in on a TV star's success."

She adds, "We turn the rest over to Mark's attorneys and have no further comment."

-- a "Glee" star -- is being sued by a woman who claims he committed sexual battery by forcing sex without a condom.

Roxanne Gorzela claims in her lawsuit ... she began dating Mark in Sept., 2010.  She says in March 2011, before she had to go on a trip to Canada, they hooked up ... and things got hot and heavy.  Roxanne acknowledges she consented to having sex with Mark -- but ONLY with a condom.

The suit, filed by attorney Philip J. Layfield, alleges 30-year-old Mark blew off her demand and proceeded to "insert his penis into [her] vagina without a condom." 

She says she protested and Mark pulled out, but re-engaged again without a rubber.

And, Roxanne says, it got worse.  She claims later that month she went to Mark's house to confront him about the emotional distress she was suffering and her "health concerns."  She says she found him in bed with another woman. 

Roxanne -- a former Playboy model -- says she demanded on the spot he prove that he was clean (no STDs) and he allegedly responded by grabbing her and pushing her to the ground.

Roxanne says she went to the cops and filed a police report the same day. 

Roxanne is asking for unspecified damages. So far, no comment from Mark.

Okay... wow. Some of the comments on here are actually kind of sickening. Like okay, nothing has been proven, and I don't want to believe that Mark would do something like this... but it would not be the first time a celebrity actually did something bad. And why do we, as a society, immediately jump to the conclusion on the woman that - just because we think we know what's going on - she's a 'whore' or a 'gold-digging bitch'?

And hey, maybe she is lying but can we not jump to conclusions until we have had more of the facts... and can we not make out that (whether in this case it's true or not) that it doesn't 'really' matter (as some comments here have).

Seriously, if what she says is true, that's a terrible thing to happen to a person, to say that it's not as bad as is being claimed is terrible. When a person consents to a specific kind of sex, then they are not consenting to anything else, and to ignore that makes it non-consensual, especially when they ask you to stop.

Also to claim that the time between the event and it coming out makes it an obvious lie is bull****. Sexual assault of any kind is degrading, and shaming and can for a lot of people be very hard to talk about. The timing between the event and when she filed the police report actually apparently wasn't that long.

So yeah, if it's a lie, it's a terrible horrible thing to accuse someone of doing, but if it's true and even if it's not, it is not okay to say some of the things people here are saying... hopefully it will be sorted out fairly and justly and whoever is in the wrong will be dealt with accordingly. In the meantime, maybe re-evaluate the way you react to claims of sexual assault, because it's not just the specific claimant you're talking about here.

The police report states Domestic Battery (not sexual) on March 15, 2011. So is she suing him for Sexual Battery and not the assault? Why? Did he give her an STD? If she filed a police report and a lawsuit 2 years ago, why is it news now? Also, how can you make someone prove you have no STD's on the spot'?

If you agree to have sex, that is not assault... it is certainly not preferable treatment if you ask a guy to put on a condom, and he doesn't, but it is still consensual if you don't take the time to make sure (it is your issue, I bet the guy doesn't care) Let us no clog up the Judicial System because some sexual partner(s) didn't care the next day...

In my opinion, there was no need to go and confront him about the first incident. Just move on because it's obvious he can't be trusted. Plus, did she expect him to be honest then?

But how did she get in his house to see he was in bed with someone else?

Also, when he pulled out after you protested, you should have gotten up and gotten the hell out, not give him time for a 2nd insertion.

I just took another look at the 'police report' She requested a police investigation for the domestic battery only (not sexual battery) on March 29, 2011. The incident happened on March 15, 2011.


What was the result of the police investigation? I couldn't find anything about it on the internet. Are we to assume the police did not file charges?

And you wait until 2013 to file a suit why??? Sorry, but that's shady. And you would think if she went to the police station and filed a police report that some investigation would have taken place and the info would have been leaked to the media, especially back in 2011 when Glee was much more popular than it is today.
