Jason Patric was just shut down by a judge in his bid to win paternity and custody rights over his son ... TMZ has learned.

Jason was locked in a bitter legal war with ex-GF Danielle Schreiber. The two were together for years but broke up in 2009. At the time they ended the relationship Jason told Danielle he didn't have any money to give her but he would give her his sperm, provided he had nothing to do with raising the child and she didn't ask for child support. 

Danielle was artificially inseminated with the help of a doctor, and Gus was born in December, 2009.  

Jason went away and had no contact with Gus, but came back in 2011. Jason and Danielle got back together ... but they broke up again. That's when he decided he wanted custody.

The trial has been going on for a week, and we've learned the judge just laid down the law -- a law that says if a man donates sperm to a woman to whom he is NOT married and she's inseminated with the help of a doctor ... the man has no paternity rights or claim of custody.

As we previously reported ... Danielle let Jason see Gus for visits, but there was no court order enforcing that.  We don't know if she will continue to let Jason see the child.

Haha typical, man is expected to give the woman money or other things upon breaking up.
Just curious...what did she give him?

That is pretty screwed up, since they got back together after the agreement. If your husband cheats on you and you forgive him and take him back, it is like the cheating never happened and you can't use it against him. SAME should go for this situation. Contract was null and void when they got back together.

Children need both parents and if he was so bad, why then would she allow him to even know his child and build a bond? Why dangle this child in front of him only to say, "keep away." Even when I was pregnant, it wasn't true love until I saw my children face to face. People say and do all sorts of stuff before a child is present in their lives. It changes you. It makes you want to be a better person. Life suddenly becomes more critical and you want to make it a better place for them. So maybe at one point he thought he could handle giving her what she wanted, but once he met his child, all that went out the window. Mothers change their minds all the time. Fathers truly don't get the same treatment as mothers and they often lose because they are male. We have this perception that somehow men are not capable of caring as much as women because they have that emotional bond while they are in the womb. Well, I have met many women who shouldn't be mother's at all and yet they are. Children love unconditionally but so do good parents (mothers and fathers). A parent will never be perfect, but if they know how to love, that is half the battle. Let him be a parent. What's worse is she's still young and may some day decide to marry. What then? She will allow someone else to be his father but not the one who contributed to his existence? Doesn't make any sense.
