slugger Andruw Jones is battling his estranged wife for custody of their son -- claiming he's the better parent ... just two months after he was popped for domestic violence.

Nicole Jones filed for divorce from Andruw back in January -- one week after the MLB star was arrested for allegedly dragging her through the garage and choking her. Charges are pending.

In the divorce docs, Nicole -- who was married to Jones for 10 years -- asked for primary physical custody of their 9-year-old son AND to have the prenup voided.

Now, Andruw has fired back in his own docs ... claiming HE should get primary physical custody, and not only that ... he shouldn't have to pony up a dime in child support.

A judge has yet to rule.

Andru...lost all credibilty of responibilty in Atlanta strip clubs. Fathered many a child on furniture in the VIP rooms. Heard word on the curb!

he could have a shot. Most judges believe/rule that just because therr was abuse towards the mother doesnt mean hes a bad parent.

Can't say for sure who the better parent is, because I don't know them personally, only a social worker could say for sure. He may very well be the better parent, but considering the Yankees schedule, I don't think it's wise to drag a 9 year old for the season or having a Nanny raise the child.

Face it, this type of DV is usually a he/said she said with and the real truth is probably they both did something that can be considered DV (just calling an intimate partner a name can be charged as DV in some states, believe it to not. Divorce is messy. Hopefully, a judge can see what is best for the child, which is usually contact with both parents. His livelihood, ie traveling, is probably going to affect primary custody issues, however. He may be facing felony charges on the alleged strangling. States are coming down hard on any charge of hands near the neck or a person saying they couldn't breathe.

Andruw was an Atlanta brave for years and that's where his son grew up and lives now. He is a student where I teach. He is a sweet kid and I think it would be a bad decision to force him to leave his life and travel around Japan.

I know Nicole Jones personally and she is an awesome Mother and all around great person! Andruw Jones is dreaming if he thinks he will EVER get primary custody of their son after what he did to the child's mother! Get real!!
