0324_lindsay_lohan_gettyLindsay Lohan struck a plea deal she CANNOT fulfill, because TMZ has learned ... the lockdown rehab she promised to do is a fiction.

Fact is ... there appears to be no non-jail rehab facilities that will keep patients in against their will -- anywhere in the U.S..

Sources connected with the case tell TMZ ... Lindsay's lawyer, Mark Heller, represented to prosecutors he could get his client into a 90-day lockdown rehab center in NYC. As we reported, there are no private NY rehab centers that keep patients against their will, except for one connected with the prison system, and you have to have a felony record to get in -- and Lindsay doesn't.

We also checked to see if Lindsay could complete her 90-day lockdown rehab in CA, but there isn't a single non-jail lockdown rehab facility in the State.

Rehab guru Dr. Drew tells TMZ, "There is no rehab that will hold you against your will, unless they feel the person is a suicide risk, and in that case they can hold the individual for 72 hours."

Here's the BIG problem. Lindsay's actual sentence is 90 days in jail, but the judge said he'd allow her to complete it with lockdown rehab. Sources say the prosecutors believed such a facility was available when they offered the plea deal. 

It would seem a typical 90-day rehab program wouldn't cut it.  Lindsay has been there at least twice before. She constantly snuck out of Cirque Lodge in Utah and allegedly did the same thing at Betty Ford in California.

On top of that, Lindsay continues to drink, as recently as Friday.

We're told prosecutors are reevaluating the plea deal to determine what they want to do.  Sources say the jail option is still on the table.

I don't know where Dr. Phil gets his info from but, speaking from experience, there ARE lock down rehab centers in being the Phoenix House. They also have a facility in NJ.

And the Judge should be fired as well. He doesn't know the law, nor have enough info about the deal.

How is it Paris Hilton and her parents hundreds of millions had to serve jail time but this broke hooker keeps skating. Aside from the multiple traffic offenses, DUI's and breaking parole, if any normal person would have comitted grand larceny as she did they would be serving years. Let a black or mexican who lives 20 miles away from where Lohan lived in California on the wrong side of town steal a 25,000 necklace or whatever it cost and see how much time they're given.

Send her to whatever rehab she wants and if she leaves the facility at any time then throw her in jail. I really have to wonder what kind of crappy lawyer Harvey was that he thinks this is actually some sort of legal conundrum.

Obvious solution: Put her under electronic house arrest for 90 days AT a court-approved rehab facility. Really TMZ, you're a acting like nobody ever got sentenced to rehab house arrest before. It's not uncommon.

LOCK her up for the 90 days-overcrowded or not! Then, when that's over, give her a week and she'll be right back in trouble and this whole comedy can continue! Way to go CA courts/judges! Wouldn't it have been a GOOD IDEA to check on a lockdown rehab BEFORE believing someone that you knew wasn't qualified to represent Lindsay in the first place!

State facilities can take people who have been sentenced to rehab.

For her own good, she should just do the jail time and get it over with already. It will sober her up and who knows might keep her that way whereas she'll find a way to stay on drugs and drink at any sober facility as has been her history,

And if they want o release her early due to overcrowding, I'll volunteer to foot the cost to keep her in. For her own good.

Legally, treatment can be forced if the person is a minor or deemed by a court of law physically/mentally unable to care for him/herself through expert testimony. The other option is to contact local Adult Protective Services (APS).

Nothing will happen to her. She will be sentenced to 90 days in jail....and she will be released within 2 hours due to overcrowding. Then she will lay low for a while and be under the radar. After a couple of months, she will be back on the news because she got in troubled for either driving under the influence, stealing, punching someone or killing someone while drunk. I am afraid for all our safety as long as this nut bag is free to drive and is still drinking. Thanks to California's screwed up justice system, this no good talentless attention whore has once again gotten away with yet another crime. What's next? She kills someone and then they'll sentence her to 45 days house arrest?
