Chris Brown to L.A. City:

My Graffiti Is Protected

By the 1st Amendment!!

0506_chris_brown_graffiti_tmz_wmChris Brown is firing back at the City of L.A. -- claiming the gov. has NO RIGHT to force him to remove the graffiti art on the front of his L.A. home because it's protected by the 1st Amendment.

Brown just filed an appeal with the city -- telling officials the bill they're trying to stick him with for having an "unpermitted" mural on the front wall of his Hollywood Hills home is pure B.S..

According to the legal documents, obtained by TMZ, Brown claims the city is wrongly trying to nail him for having an illegal "sign" -- when the graffiti is art that "[enhances] the architectural and aesthetic features of the residential property."

Translation -- my artwork makes my house look dope, son!

Then Chris drops the constitutional bomb -- arguing, "The murals are a reflection of [my] aesthetic taste and a reflection of free speech and expression protected by the First Amendment to the United States Constitution."

Brown's case is now in the hands of the Dept. of Building and Safety's board of appeals -- and if they shut him down, he can bring the fight to L.A. County Superior Court.

In fact, there's a chance ... albeit a small chance ... that Brown's case could go all the way up to the Supreme Court if he's not willing to back down.

Its not ART its tacky he's only doing this because he wants to stick it to the neighbors. If he was one of my neighbors and did that I would put up a sign call it art saying that Chris Brown is a women beater, has no talent after all isn't that free speech. I wonder how long he was want to keep it up after that.

The value of his house is gone down you can't remove the paint from cement so they would have to paint over the cement if he wanted to sell the house that wouldn't look good so I think he just lowered the value of his own house.

Chris brown is an artist. Whether it's his music he displays it through or his paintings! And drop the whole Rihanna thing! It's been 4 years now! Find something better to do then bash on him, you low-lives!

Let me say first of all, I was watching TMZ this afternoon where as one of your crew members was saying that Chris Brown should have the right to have the murals outside his home because he also pays alot of money to live there. Well shame on you. Let me ask first is there an HOA in the community where they all live? Next, yes he may also pay alot of money for living there but who wants to come out of their home every day and look at this so called art of his. Well if he wants to display this kind of art then put it on canvas inside your home. Not everyone thinks this is art. Right now it looks more like East L.A. where there is alot of crime. And yes because of this the value of the homes would be way down. Just because of whom he is does not always mean that the value would go up because a celebrity lives there. Remember he may be in the lime light and people know who he is, he's still just a human being who makes alot of money. Excuse me but his S_ _t smells the same way as everyone elses. Celebrity or not you follow the same rules as anyone else. And please quit egging them on with money talks. We all know that's true but what are we teaching our kids now a days, that's why this world is the way it is because we allow this to go on.

Oh, Chris. Go back to school. The 1st Amendment protects political speech. It doesn't mean you can do anything you want. You live with other people in a community and so there are limitations on such things. You can't grow grass and weeds ten feet tall in your yard (the city will mow it and send you the bill). You can't conduct business in your home unless you meet the zoning law requirements. You can't make as much noise as you want or else you'll have police on your doorstep telling you to turn down the volume. And your community has laws about what you can inflict on your neighbors in the name of art. sorry. Just take it inside.
