Veteran character actor Jeffrey Wright  dodged a bullet today when New York prosecutors dropped his DWI case.

TMZ broke the story ... Wright -- who's been in about a million movies (roughly) -- was popped by cops back in April on suspicion on boozing while driving. Cops claimed he failed a field sobriety test ... failed miserably.

Sources close to the case tell us ... NY State prosecutors decided to drop the case, because of a lack of evidence.

Here's what's a little wonky.  If Wright failed the field sobriety test so badly and he can be prosecuted for driving while impaired (even with a very low blood-alcohol level) -- where's the lack of evidence?

maybe the person who did the field test is unavailable to provide testimony- or, isn't credible. also, why wouldn't they have done a breathalyzer or blood test- or at least tried? sounds like someone majorly ****ed this one up. if he refused those tests, he'd be out of a license. they mustn't have even tried. nobody wants to go to court with no evidence except one witness. dumb.

Common in "big city" cases that if you don't have a chemical test (breath test refused) or video of the field sobriety tests, the prosecutor drops or "deals" the case because of the sear number of DUI trials. In suburban or rural jurisdictions these are much more likely to be prosecuted.

When a member of the pd doesn't show (3)times(happens all the time)or is off...or the officer's boss has him doing something else that day...or knows someone who knows this guy..they don't show...especially if he's never had even a ticket. They can't be bothered in NY&I am sure he hired a lawyer who treated the case like a felony&raised hell every time the officer didn't show.
Again, if his record is clean..they would rather not do the paperwork.

There are still flag flyers out there who will swear that the American court system is has integrity, impartial, honest, god fearing and cannot be influenced by money or status.

He could have failed the field sobriety test because of physical or inner ear problems. When he was then blood or breathalyzer tested it showed he was within the legal limits. Personally I dont know why any one would submit to a field sobriety test, breathalyzer or blood is really the only fool proof way to go.,
