Mark Salling

State Farm is 'Despicable'

Mark Salling doesn't buy that State Farm is like a good neighbor .... he's suing the insurance company, claiming its refusal to cover him against sexual battery allegations is "despicable" and "malicious."

TMZ broke the story ... Salling was sued by a woman who claims on one occasion when she was dating the "Glee" star ... she insisted that he wear a condom during sex but he refused and forcibly had unprotected sex.  The woman -- a former Playboy model -- claims she went to his house later that month to demand proof that he was STD-free, and he responded by pushing her to the ground.

Salling claims in his lawsuit the State Farm homeowner's policy requires the company to foot his legal and other bills connected with his defense, but State Farm has repeatedly refused.

Although there's no mention as to why State Farm won't cover Salling, we're guessing the insurance company is hanging its hat on a provision that excludes criminal acts from its coverage.

As for the sexual battery case against the actor ... it's ongoing.

If he was fortunate enough to have assets Like actual money and paid for property to protect then chances are he would have an umbrella policy to cover a lot stuff that might happen maybe even things like this .

State Farm might cover his legal bills IF the woman's lawsuit went after $ from his homeowner's/umbrella policy b/c her "injury" happened at his property, like if you broke your leg at someone's house.
Same way if you got sued for a car accident, State Farm's lawyers defend you b/c they'd be paying if you lost.
State Farm would probably defend you even if you committed a crime like vehicular manslaughter, to avoid paying the full policy.
I don't know if State Farm has to pay on the homeowner's policy if he loses, because the crime happened at his house.
Criminal acts are probably specifically excluded from homeowner's policies. Some policies won't pay for flood damage...but car insurance has to pay for your accident even if it was a crime.

What an @sswipe... you rape a woman & expect your homeowners insurance to pay for your criminal behavior... I hope you wind up in prison where Bubba & Jamal do to you what you did to that woman...

Homeowner's insurance covers negligent, not intentional acts. Sandusky also tried unsuccessfully to get State Farm to pay his legal defense: http://www.insurancejournal.com/news/east/2012/07/23/256808.htm

State Farm DOES suck, but this guys claim is just ridiculous. They won't even cover COVERED issues, much less this stupidity! We left them and went to Hartford.

How the hell is State Farm responsible for you allegedly raping some chick? Unless they held her down, this one is on you.

Hmmm he forcibly had unprotected sex and they won't cover? Why should they. And they won't cover his defense? Why should they? No wonder our premiums are high. They cover **** like this? Unbelievable! Guess ill talk to my agent!

I think State Farm has a special clause in their contract that allows them to deny coverage to rapists and other perverts who force themselves on women, Mr Asshat. You should go to prison, low life. Imagine if insurance companies paid to defend rapists! Then a lot of perverts would force themselves on women without any regard for the potential financial consequences.

Yeah, because the best time to ask your partner about potential disease is always AFTER sex.
