Rolex Theft Victim in Death

suffered an indignity after he died in Rome -- someone apparently stole his expensive Rolex watch within hours after he died ... TMZ has learned. 

We've obtained an insurance form filed by James' people.  According to the form and family sources, someone stole a $3,000 Rolex submariner watch from James' hotel room on the day he died.

The insurance form says there was no damage to the room and there's no mention of forced entry.  There's no suspect listed on the form ... but the implication is that someone may have pilfered the item during the commotion following the heart attack that killed the actor.

The form doesn't specifically describe the type of submariner that was stolen, but they vary wildly -- some are diamond encrusted, some are platinum and some are gold.

We found a pic of James at the "Nicky Deuce" premiere in May -- a month before he died -- and he was wearing a watch that could be the Rolex in question.

Just because there was a $3000 insurance policy placed on the watch doesn't mean the watch is worth $3000.

Stealing a dead man's watch? I can see karma coming...

TMZ... there are no Rolex Submariners that cost $3000. The one that James is wearing is an older Submariner which retailed for around 5000-60...00. Even on the used market its a $4500-$5000 watch. There are no diamond encrusted and platinum Submariners. Only diamond encrusted GMT masters and platinum Day Date or Daytonas.

Value of a USED stainless steel submariner with a black face is around $3000 - $3500. You could actually buy reconditioned ones on overstock for that price a year ago. If the policy dictated you get the replacement value of a NEW submariner like in the photo, you'd be talking $7,500 - $8,500 but if the policy dictates that the value is for the actual item vs. replacement, a used watch like that WOULD be $3,400 and the insurance appraisals always favor the greedy insurance companies, so $3,000 is an accurate estimate. Or, you could go to Times Square and get one for $100 that will last just as long and not need yearly cleanings and tune ups for $400 per pop.

Concerned sources tried contacting Gandolfini to see if he cared that his watch was stolen but Gandolfini had nothing to say. Those close to him say they are going to ask the makers of Rolex to design a watch that goes to infinity so that they can dig Gandolfini up and make sure Gandolfini has a time piece...in case he comes back from the dead.

Rolex doesn't make a $3,000.00 watch, especially a submariner...but that's pretty messed up, happens to people i know too often in Europe (robbed by hotel cleaning people)!
