Dolphins' Incognito Won't Press Charges in

Helmet Attack

No blood no foul in the case of the violent helmet swinging incident between Houston Texans Antonio Smith and Miami Dolphins Richie Incognito -- because Incognito is willing to let it slide ... TMZ has learned. 

Sources close to the Dolphins offensive lineman tell us he has no plans to press criminal charges for the vicious altercation during Saturday's preseason game.

The video, first aired on FOX Sports 1, is ugly – while the players were grappling, Smith ripped off Incognito's helmet and swung it HARD right at his noggin.

We're told Incognito's totally fine, so at worst it was probably a grazing shot -- but considering NFL helmets weigh as much as 6 pounds of hard plastic -- Smith could've done some serious damage. 

Houston police and the Harris County Sheriff tell us they would only take action against Smith ... if Incognito filed a complaint.

Smith's not off the hook with the NFL, which could suspend him. A league spokesman says the case is "under review.”

JJ Watt this morning on the Dan Patrick show was talking about the crazy smack talker than Incognito is. Way beyond normal apparently. There's a reason he didn't want to press charges.

Bottom line, it doesn't matter what Incognito may have said or didn't say, He's not on camera ripping off Smith's helmet and swinging it at his head! These athletes all say loads of things to each other to get into their head. You have to keep your cool and realize this. They have bad blood also last year Smith said Incognito was twisting his ankle,at bottom of pile and Smith was fined for kicking Incognito. Again we don't see Incognito twisting ankle, maybe he's better at getting in opponents heads,mentally, whatever,if he was caught swinging helmet at another guys head NFL would fine him.Smith should be arrested for assault, this is beyond NFL.

You never have the right to physically harm someone regardless of what an a$$hole they are or what comes out of their mouth. It is against the law people.

Igcognio is a sorry a$$ so he deserves more than that...he tried to break Smith's ankle last year twisting repeatedly so he deserves more than that! I'm glad Smith did that...should have used his fist but oh well! There's a reason why he's not pressing charges...he knows he deserves it!

NFL is like boxing. You know that if not for being a paid pro, alot of these guys would be in prison for their violent tendencies. Hope the NFL comes down hard on this guy.... Maybe suspend him for the entire season.

This Proves there is no Merritt in Players Lawsuit against the NFL for Concussions. If Players do not care about getting hit in the head when there helmets are removed and used as a weapon to injure a player, than they just do not care about concussions.
