David Tutera -- the host of "My Fair Wedding" -- followed the biblical path in his split with Ryan Jurica  -- he gets one of their twins, and Ryan gets one.

The two men had a 10-year domestic partnership that blew apart in January ... and it got UGLY.  And there was a big complication -- they had fraternal twins through a surrogate in July, and that triggered a bitter custody battle.

Now here's the complication.  Each man fertilized an egg that was then implanted in the same surrogate, who gave birth to the two babies at the same time.  It appears the eggs are from the same biological mother. 

Sources familiar with the situation tell TMZ ... a judge has issued a temporary custody arrangement in which David gets custody of his biological child, baby girl Cielo, and Ryan gets custody of his biological child, Cedric.

We're told David and Ryan are "close" to a final settlement, where the temporary custody arrangement will become permanent. 

We're also told the two men are getting along.  It's unclear if they will each get visitation rights of each other's kid. So we gotta ask ...

This happens to gay couples and heterosexual couples a like.

About the kids, the kids shouldn't have to be split up -- it's not their fault. They both have to split time with the children not split children up.

As the father of twins (identical girls 20 months old) It is inconceivable to me that in this day and age that anyone would even consider splitting up twins. The relationship between twins, even fraternal twins is one of the most amazing things to watch. Splitting them up is perhaps the cruelest thing you can do and will ensure that as they get older, they will hate both parents for taking their sibling away.

The stupidest thing you can do to children is split them up. That is done out of pure selfishness with no thought for what's best for the kids.

I do think it is funny to see all these gay couples now having to deal with the hassles of what comes along with marriage and kids. It's not all what it's cracked up to be now is it you homo's? This is the only reason I ever supported gay marriage, gay divorce. I figured if they really want the hassles, headaches, and BS that comes along with marriage, then fine, go for it!!

While it may sound fair, that is actually outrageous. Those children, while they may not have the same father, are TWINS. Since their conception they have been together. Twin research suggests this is an EXTREMELY strong bond, both for biologic and environmental reasons. They are damaging those children's psyches.

This is one cold SOB. Notice how he says they're not "full" brother and sister? How many people do you know with a sibling that has one different parent, views them that way? Those babies are brother and sister and born as twins. Separating them like this is seriously f *& ked up and this dumb *ss dude is in for some serious karma down the road. He'll probably fall in love with some guy that doesn't want to be bothered with his daughter because it doesn't have the guys dna in it, or something like that. As Stevie Ray Vaughan says, "Thats a cold shot".

I am a twin and me and my sister did everything together while growing up. We slept in the same bed until we were teenagers. We were really close. They are denying these kids of that closeness that comes with being a twin. You need to rethink your decision or they will hate you both and end up in counceling or rehab. Just sayin

Fact is they're biologically siblings. It doesn't matter that they're half siblings (as emphasized by David Tutera), and it doesn't matter that they're only a couple months old. It doesn't matter that the parents are gay, straight people do stupid ish too. What matters is that they're being raised by two people who sound rather immature and selfish. Sure...your marriage was on the skids for 6 years so let's make some babies. STUPID IS UNIVERSAL!

I think it sounds unfair to the kids the way you write it, but the truth is the children were not even born yet when the two of them split up. They are just babies, and have not been raised as siblings, so there is no reason why they should share custody of them both. We don't know if the same donor provided eggs for both embryos, but even if she did, it's no different than if she'd donated embryos to two different couples. I think the children should certainly have a relationship with one another, but that does not mean the fathers should share custody of them.
