Kelly Osbourne is suing her former landlord, and it's not just for a lot of money.  She's also defending her honor that she's not a filthy slob.

In the lawsuit, obtained by TMZ ... Kelly says she rented a fancy apartment in West Hollywood, which has been home to many a celeb, including Lindsay Lohan, Adam Lambert and Brody Jenner

Kelly plunked down $18,700 as a security deposit before moving in.  When she moved out, she claims the landlord never bothered to stop by to check out the unit, but shortly thereafter Kelly got bad news -- the landlord sent her an email notifying her of an estimate of damages.  According to the landlord, the damage and cleaning expenses ate up her entire deposit so Kelly was informed she'd be getting zilch.

Kelly is suing for her deposit back, and under California law if the landlord wrongly retained the deposit she gets up to twice the amount.  She also apparently thinks the landlord is an a-hole, because she wants punitive damages to teach the landlord a lesson.

I thought under CA law, if there isn't a list re: condition of the apartment upon moving in, then when moving out, it's assumed to be in the same condition. If there is a list, well, I don't know why a person would move out without making sure someone came by to check everything off first. Either way, I don't know why one wouldn't. And make them check the apartment in front of you, too. Common sense.

Oh, hunny! I have been there. First you take pictures of everything before you move in - especially the refrigerator! Make sure ALL the racks are there. That's what they really like to screw you on! HAVE ALL the pictures signed by a notary because you need evidence to prove you didn't trash the place. Take pics of your carpet and walls, too. It's a crime what these 'landlords' do to people.

In CA three times the deposit is possible but the max judgement in small claims is $7500. When you move out of a rental always give 30 days written notice, get signed return receipt, leave the unit/house in the cond you rented it, take pictures before and after rental. (if poss do a walk through b4 & after lease)
