Porsche's Been Sued BEFORE

Over Deadly Carrera GT

wasn't the first to allegedly experience mechanical issues inside a Porsche Carrera GT -- TMZ has learned, the car company was sued over a deadly 2005 crash involving the same vehicle ... and it paid dearly in a massive settlement.

According to the lawsuit, two men (a driver and his passenger) were killed on a California race track while driving a 2005 Carrera GT ... hitting a wall at over 100 MPH while trying to avoid another car on the track.

The family of the passenger sued practically everyone involved in the accident for gross negligence -- and won $4.5 million in a giant settlement ... $350,000 of which was paid by Porsche.

The lawsuit alleged the GT didn't handle correctly on the track -- and according to the attorney for the victim's family, Craig McClellan ... sworn testimony from several Porsche experts confirmed a major design flaw with the GT is it doesn't have a Porsche Stability Management system.

We're told the PSMS uses a computer to correct the car if the rear end loses control -- and it is now required by law.

For Porsche's part, the company denied liability -- saying the car fully met federal safety standards at the time -- but it still paid its portion of the settlement to avoid further litigation.

It's unclear if Roger Rodas' Carrera GT had been fitted with a PSMS -- but McClellan says ZERO 2005 Carrera GTs (like Roger's) came off the assembly line with the system.

PSMS or not, it's worth noting the car has been a HUGE legal pain in the ass for Porsche. So far, Paul's family hasn't filed a lawsuit.

Porsche should have included a PSMS? Why stop there? Why not include a chauffeur who knows how to handle the car and drive it for you? How about a speed limiter that prevents it from exceeding the speed limiter? Sue the city for not providing enough cops to enforce speed limits everywhere. Sue the maker of Rodas' bed because he didn't get a proper sleep the day before. If only these things were done, Paul won't have died. Bastards.

except in that case the driver was doing what he should have. taken this incredible machine to a race track. walkers friend was trying to do burnouts on a busted up city street. everyone is saying the guy was a pro driver. maybe he can drive if everyone who coddled him set the right conditions. leaving him to his own devices stole a brilliant young star from the world.

As a nurse, I could tell you about the Honda Accord that caused a young man to burn to death back in 2000 on my shift. He barely made contact with the tree and the car exploded into flames. His recorded speed was 48 mph.
Rachel and Jackie Houck were twin sisters who died in a fiery crash just like Paul did. While not famous, their deaths caused Senators to pass laws regarding certain vehicles.
There are many other vehicles that explode on impact, including the Ford Pinto and Chevy Trailblazer, so it's not just limited to high performance Porches and doesn't always have to do with speed.
My point is that the more I hear about Paul's crash, the more I am convinced that they were not racing and there was nothing to prevent that crash that day other than not driving. Unless you can pull every record of inspection prior to that day, you don't know the extent of mechanical failure or anything regarding this car. I think the fuel line severed upon impact and sadly, these guys lost their lives. It's what caused their accident that really matters here and again, I don't believe speed was a factor. My heart goes out to the families of both victims.

Saying that the car should have had a traction control system to prevent the accident is crazy. They can't defy the laws of physics. We've all been there. We've all pushed a car too hard sometimes. Most of us survived the risk. I wish Paul and his friend did too! Boys will be boys and gun it on an empty street from time to time. No foul there. But this is just proof of the risks! Maybe this is a lesson and will save lives.

Harvey, why don't you send your staff out there and tell us what it's like when you go down that hill ? Try to get some facts?! I've heard there's a dip in the road and that there have been other accidents there, especially after rain. Come on, I'm curious!

It is evident, that the drivers in a Porsche GT are so well protected in their carbon fibre chassis and seats, that they survive almost any impact. So it is almost 100% sure that Walker and his driver got burned slowly while trying to get out of the car. ;)

I'm surprised TMZ didn't go into more details of the previous crash. One of the victims was actually a quite famous internet marketer at the time named Corey Rudl (his first hit product was even about how to buy a car). It was the first thing I thought of when I saw the "before" picture of the car.

Porsche does not have PSMS.

What they have is PSM = Porsche Stability Management = ESP

Carrera GT is a street legal Le Mans prototype class race car, without PSM and with manual 4-plate racing clutch gearbox only. There is no launch control or computer-controlled dual-clutch automatic transmission like on Lambos that girls can drive.

I see no success in suing over an accident on public roads with this car.

Its like all these little idiots driving around in lowered Honda Preludes with the fat mufflers. These are the idiots that are wearing the ball caps with the flattened out bill and the tap out shirts with shorts past their knees and sandals with a bunch of tats. They go watch all the Fast and Furious movies and while listening to rap while driving around in their lowered Honda Preludes think they are somehow bad azzez when in reality they are all clowns.

I don't know, but this is the second time a celebrity has died in a crash in a Porsche that exploded and the occupants turned into crispy critters. Maybe Porsche should be investigated and deemed unsafe..The other celebrity's name was Ryan something, from the Jackass group.

You can thank the ******gers and Republicans for keeping these kinds of cars available. Jimmy Carter and the Democratic Party did their best to discourage these kind of cars. Remember the 85mph speedometer? After the so called "muscle cars" of the 1960...'s Progressives saw the need to reign in these speed killer machines. There is no need for anyone to have a car that exceeds the speed limit. Just like they oppose reasonable restrictions on firearms, the right wingers also oppose restrictions on fast and non-environmentally friendly cars.

Remember to vote Democrat in 2014 to get these death machines off the roads!
