Porsche's Been Sued BEFORE

Over Deadly Carrera GT

wasn't the first to allegedly experience mechanical issues inside a Porsche Carrera GT -- TMZ has learned, the car company was sued over a deadly 2005 crash involving the same vehicle ... and it paid dearly in a massive settlement.

According to the lawsuit, two men (a driver and his passenger) were killed on a California race track while driving a 2005 Carrera GT ... hitting a wall at over 100 MPH while trying to avoid another car on the track.

The family of the passenger sued practically everyone involved in the accident for gross negligence -- and won $4.5 million in a giant settlement ... $350,000 of which was paid by Porsche.

The lawsuit alleged the GT didn't handle correctly on the track -- and according to the attorney for the victim's family, Craig McClellan ... sworn testimony from several Porsche experts confirmed a major design flaw with the GT is it doesn't have a Porsche Stability Management system.

We're told the PSMS uses a computer to correct the car if the rear end loses control -- and it is now required by law.

For Porsche's part, the company denied liability -- saying the car fully met federal safety standards at the time -- but it still paid its portion of the settlement to avoid further litigation.

It's unclear if Roger Rodas' Carrera GT had been fitted with a PSMS -- but McClellan says ZERO 2005 Carrera GTs (like Roger's) came off the assembly line with the system.

PSMS or not, it's worth noting the car has been a HUGE legal pain in the ass for Porsche. So far, Paul's family hasn't filed a lawsuit.

Get off this stupid azz spin on how it's the car's fault. Two men were traveling at 100 MPH on a CITY STREET and piled into a POLE. Twice today TMZ has tried to pull attention away from that fact. I laughed and laughed at the post here waiting with great anticipation of the autopsy report! My God, it's pretty effn' clear what killed these two men. Roger Rodas lost control of the car and had it been a Maserati or Lambo, the same thing would have happened at 100 MPH. You just are unable to put the blame where it belongs, TMZ. Get over it and stop blaming or worse yet, BUILDING lawsuits for Porsche.

Any vehicle that is slammed into a pole at 100 MPH is going to burst into flames. Additionally, lawsuits are filed but that doesn't mean there is any validity in the cause of action. Secondly, we settle them out not because of any real truth in the cause of action but BECAUSE IT COSTS MILLIONS TO TRY THEM IN COURT. It's cheaper sometimes to throw money at them. This doesn't not mean Porsche accepted ANY liability or believes there is any facts relating to product liability. It simply means it's cost affective. Here is the SAD PART in this post: These TMZ lawyers KNOW that any settlement that ocurred doesn't mean crap. And still they post this a completely irresponsible and misleading manner.

It wouldn't have mattered. Most car enthusiasts who fancy themselves as "skilled drivers" turn off the stability control system to have more fun. Undoubtedly the driver in this accident would've just switched it off anyway.

Death certificate wont state: died going 100mph in a Carrera gt, it states what killed them specifically. So stop saying its the car, its the driver, its the speed. These are CONTRIBUTING FACTORS but not how they passed. And have some ****in sympathy for the loved ones who hope that they passed unconscious or quickly.

Not comparable at all. They weren't on a track. Shouldnt have been going 100 MPH on a city street whether it was empty or not, racing or not.
