Duckhorn Sues Duck Commander

Duck Commander is being sued by a high-end Napa winery with a simple premise ... if it walks like a duck ... then we own it.

Duckhorn Wine Company claims in a lawsuit -- obtained by TMZ -- its expensive, ultra-premium wine brand -- which goes to nearly $100 a bottle --  is being diluted by Duck Commander's cheap, Walmart line of vino -- which goes for $9.99.

Check out the two labels.  Duckhorn claims customers are getting confused by the 2 and buying the cheap stuff at its expense.  What's worse for Duckhorn ... the company claims when you search online for duck and wine, all you see is Duck Commander. 

And here's what really pissed off Duckhorn, which sold its wine years before Duck Commander.  The D.C. blends cheapen the brand, with names like Triple Threat Red Blend, Wood Duck Chardonnay and Miss Priss Pink Moscato!

And to add insult to injury, Duckhorn grouses when Duck Commander launched its brand, it threw a drunken, redneck party in hoity-toity Napa ... a stone's throw from Duckhorn's vineyard.

Duck Commander scoffs at the lawsuit ... claiming that Duckhorn has no monopoly on the word "duck."  They cite other duck trademarks, such as Long Duck, Duck Shack, Ugly Duckling, and Duck Duck Goose.  But our favorites ... Orthoducks and Ducklebery Grunt!

A judge has yet to rule.

Phil, Willy and Duck Commander Wine will blow the doors off that 100.00 bottle stuff.

It sounds like this Other Duck Wine is so expensive nobody wants to pay 100.00 for a single bottle. This other Duck Wine Guy is looking for some free advertising. He will lose, Duck Commander has every right to sell the wine with thier label.

I looked at a wine list buying guide and it says Duckhorn wine is not recommended.

Now the backlash will hurt this guy more than he ever thought. Now we will all know not to buy his brand.

America is all about competition, ten bottles of Duck Commander vs. 1 bottle of 100.00 Bill Wine.

Anyone who cant' tell the difference has a real problem. The word "duck" is not and cannot be copyrighted, Duckhorn is one word and Duck Commander two words, and there is not even the slightest resemblance between either the bottle shape or the label. It seems that everyone is sue-happy these days , clogging our courts with frivolous lawsuits such as this one.

My friends and I used to drink a really cheap wine called "Baby Duck" years ago when we were like 16. It was probably the cheapest & sweetest wine ever made. Definitely NOT from Napa Valley!!!

" LOL I seriously doubt that the $100 a bottle wine is being sold at WalMart, or that the hoity toity elite group will make WalMart its first stop for wine purchases. Everyone wants to get in on the Duck Dynasty popularity these days. I think it's a bunch of "sour grapes" myself.

Yeah, I'm calling BS on their claim that when you search the words duck and wine that all you get is Duck Commander. I just googled "duck wine" and the very first link was for Duckhorn.

This might not even be about the word "duck". It may have been pointed out that filing a lawsuit is potential for some really cheap national advertising. I've never heard of that wine before, but I have now.

Duckhorn is manufactured by Duckhorn Winery in St. Helena, California. The Duck Commander brand is manufactured by Trichero Family Estates Winery, also in St. Helena, California. So is Duckhorn suing Duck Commander or its manufacturing rival, Trinchero Family Estates? Interestingly enough, TFE has quite a few labels, including Sutter Home and laughingly a brand called Fancy Pants and (lol) Menage à Trois (lol)! Did The chickens "grouse" when those lines threw their (uhh hmm) Launch Parties?? Lol

I wonder if our Obamanation economy has hurt the high priced Duckhorn brand wine & some attorney friend of theirs thought this would be a good way to recoup some of their loses?

With the economy totally tanked & the Middle Class coming to the full realization of their increased Obamascam premiums looming, I can see where $100 bottles of wine like Duckhorn would be a low priority.

Unless Duckhorn has Service marked (trade marked) the word "duck", I think this should be considered a frivilous lawsuit. Just depends on the Liberal judge.
