Trigger U.S. Military Investigation [PHOTOS]

The United States military is conducting a formal investigation into American soldiers burning the dead bodies of what appear to be Iraqi insurgents.

TMZ obtained 41 pictures that we're told were shot in Fallujah in 2004.  Two pictures show a Marine appearing to pour gasoline or some other flammable on the remains of what officials believe are 2 insurgents.  Two other photos show the bodies on fire.  You then see charred remains.

Another photo shows a Marine crouched down next to a dead body and mugging for the camera.

Still another pic shows a Marine rifling through the pocket of the pants on a corpse.

We have not included all of the photos.  Many are just too gruesome.  There are well over a dozen bodies in the pics and some are covered with flies and one is being eaten by a dog.

We turned them all over to the Pentagon last week, and a Pentagon official tells us the pics have triggered a Marine Corps investigation.

We're told U.S. Central Command -- the organization in charge of military operations in the Middle East -- also reviewed the photos to determine if they had been previously brought to their attention and determined they had not.

Col. Steve Warren, Director of Press Operations for the Dept. of Defense, tells TMZ ... the pictures appear to show U.S. soldiers in violation of the Uniform Code of Military Justice ... which makes it a crime to mishandle remains.

There is no statute of limitations on the crime -- even if the soldiers are now private citizens ... they can still be prosecuted, which could land them behind bars.

Col. Warren tells TMZ,  "The actions that are depicted in these photos are not in any way representative of the honorable, professional service of the 2 1/2  million service members who went to war in Iraq and Afghanistan in the last decade."

If they're no longer in the military how can they still be prosecuted under UCMJ? Uniform Code of Military Justice? A criminal civilian court would have jurisdiction. Right, Harvey?

Wow. Really young, really ignorant posters here. It is extremely important for too many reasons to list, for our soldiers to follow the rules of law and proper military protocol in situations like this. I married a Marine vet in 2003 and I know how undisciplined, and frankly stupid, many recruits can be. This is not a good look for America. If for no other reason, we should be doing the proper thing just so other countries don't do it to our soldiers in retaliation. The comments here are why America is so hated.

Why do you care how these insurgents remains were handled? What you fail to realize is that it was the intent of these INSURGENTS to KILL members of our Armed Forces. Obviously you don't have any members of your family who have deployed or been killed by insurgents, otherwise you wouldn't give a f**k what happens to their remains. On top of that you bring up something that has happened over 10 years ago. These people have fought and risked their lives for this country and you repay our service members by disrupting their lives and possibly sending them to jail for pieces of sh&$ who tried to kill them just for a "good story" Its obvious you could give a damn about the people who fight for YOUR freedom to write these "stories". TMZ please stick to your TEN MILE ZONE and report about something you think you know about: spoiled brats throwing eggs and celebs sex lives. Sincerely a pissed off OIF Vet

The proper thing for TMZ would be to turn photos over to authorities and keep your mouth shut. It is un-American to jeopardize our country's security by posting such images. Certain things should be handled with greater care.

In most places there is a legal principle that you cannot provoke someone to fight you, then claim self defense. In this case the man's outrageously insulted and verbally abused a man's wife. The man defended his wife. Even a reasonable person in that situation would be likely to fight under those cir***stances. I do not defend Kanye's crazy behavior, but in this case, not many real men would have done much differently.
