Cops Claim of

Drag Racing Doesn't Hold Water

0124-justin-bieber-drivingMiami Beach cops claim Justin Bieber was drag racing at the time of his arrest Thursday ... but the facts seem to show the allegation is MADE UP ... because we've learned they were actually UNDER THE SPEED LIMIT in the middle of the so-called drag race.

According to the police report ... cops spotted Justin and his buddy Khalil drag racing at around 4 AM.

The police report says ... an officer observed the 2 vehicles reaching speeds between 55 and 60 MPH.

Now the problems.  

Cops say they noticed the "drag race" on the 2600 block of Pine Tree Drive.  Cops were traveling in the opposite direction so they made a U turn and pursued the cars for 15 blocks.

Mind you ... Justin was driving one of the fastest race cars around -- a Lamborghini Gallardo LP550-2 Spyder.  Khalil was driving a Ferrari 16M.  Cops claim 2 SUVs in Justin's entourage actually blocked off traffic to give the 2 a clear path.  

So how could a 15-block drag race in those cars reach speeds of ONLY 60 MPH?


TMZ has learned ... the place where Justin and Khalil rented the cars attached a GPS device that also tracks speed. 

The GPS clocked both cars at 27 MPH at the 3500 block of Pine Tree Drive ... smack in the middle of the so-called "drag race."

There's only one time they ever broke 50 MPH and that was long before the pursuit started.  When Justin and Khalil left the club, one car was briefly clocked at 52 MPH and the other 47 MPH. Both drivers slowed down pretty quick and 5 blocks before cops noticed them they were going 34 MPH in a 30 MPH zone.   Blocks later, they were steady at 27 MPH.

 So it seems cops goosed the facts to justify the stop.

And that's not the only problem with the police report.  TMZ broke the story ... Justin's blood alcohol level was .014 -- a barely measurable amount.  Yet cops claim Justin reeked of alcohol both at the scene and at the police department.

Posted the other day, got to watch those cops in Florida, they love to prey on snowbirds celebrity or not. Rental cars license plates in Florida have an X in the license plate numbers making snowbirds an easy target for cops.

TMZ broke the story 2 days ago that Beiber's alcohol level was 04. Now they are reporting it's .014. Which is it TMZ?

1. Beib's failed his field sobriety test.
2. Beib's lied to the cops saying he came from a recording studio when in fact it was from a nightclub.
3. Beib's resisted arrest.
4. Beib's agreed to a breath test & drug evaluation.
5. Beib's was driving on an expired license.
6. Beib's admitted to drinking 1 beer, smoking pot all day and had taken 1 benzo that his mom gave him.

TMZ has now changed their story regarding drag racing using the GPS story. Whether Beib's was drag racing on Pine Tree Drive will be proven by witnesses in the area and the video's the girls following them had taken. Beibs was NOT charged with speeding or drag racing. See the police report above.

Bottom line, he should not have been driving a vehicle. Stay week let's see if he gets charged with a felony for causing $20K worth of damage for egging his neighbor's house.

Beib's may chronically 19 yrs. old but he's 10 mentally.

Okay, so let me get this straight, his was depicted unjustifiable guilty before proven innocent by the media and when it comes out that he probably shouldn't have even been pulled over, it is evident that his camp paid everyone off. Come on everyone,this guy is crucified no matter what he does. Oh and as for resisting arrest,wouldn't you if you didn't do anything wrong or if the police were fabricating the situation? I'm a 27 year old mother to a 8 year old boy and we discuss Justin when the media scrutinizes him and as a mother, my heart really goes out to him. To wish death on such a young life, talent or no talent, shows how much the human racehas prospered. It makes me sick to my stomach to see the way some people react toward him. Grow up and have a heart, what if he was your son?

So the GPS device shows he was speeding anyway. It is true it looks like the cops were lying or exaggerating, but in order to prove that, the GPS device will show they were in fact speeding. It sounds like a no win!

If theses are in fact true, the cops should be the ones in court facing harassment charges as well as filing faculae police reports, I don't like Beiber, but if these are the rue facts, let justic take it's coarse

I think I'd be more trusting in a cop's eyes observing a car that can go from 0-60... in 4.2 seconds than a GPS that probably only updates every 5 seconds at best. Even your own crack reporting shows that the speeds are being clocked at 5 block intervals. Regardless, 34 in a 30 is speeding and you can get pulled over for that - I've been pulled over for 22 in a 20.
Come on Harvey "I'm a Lawyer" Levin - take that Scooter Braun money out of your pocket.

Last I checked still illegal to drive with any amount of alcohol or drugs in your system. The .08 illegal limit is a joke and they will charge you with DUI for less. As for drag racing, meh! Exhibition of speed is also a way they can pull you over. They could have been revving the engines. Would sound, and give the appreance of racing--lastly, smelling alchol on his breath is possible even if his BAC is so low. I would know, I've had plenty of beers or liquar, been sober hours later and wreeked hours later. Durrrrr!

This is how the case will play out-

Beib's urine will show other drugs on-board and that will kill any hopes to get the case dropped on the sobriety issue.

The cause for pulling over the yellow Lambo will be the battle royale with Roy Black going after every seed of legal dope to get the State Attorneys to blink and offer a simple "careless driving" plea - Roy will sift through the internal affairs files, he will get copies of all the radio communications and he will ask for text traffic between the cops involved. He will say the cops made up the racing part.

The cops - All they have to justify is excessive speed, the Lambo tires spun upon excelleration in the unsafe condition. Racing does not have to be proven -

IF THE traffic stop itself is not thrown out - It will be game over - because Bieb's pizz is going to have 3 different drugs in it...not a single one, legal/

Except in the footage you can tell he's going faster then the 35 mph speed limit. It also only takes a swallow of alcohol to smell like it. Also DUI isn't just about alcohol. It also includes drugs like weed and prescription drugs that impair you. He admitted to all three.

It shouldnt matter how he was pulled over, the law states that even if u are falsely pulled over, but other crimes found in the process are fair game.....thats what happened to me, cops said i was doing 65 in a 50 but when he found weed in my car, they ended up dropping the speeding in court and slapped me with a d.u.i. and possession, but because they found other stuff, i had to fight a d.u.i. for two years, so make the kid work for his freedom like every other person should have to

It goes to show that cops LIE ALL THE TIME! Every DUI police report has the same language. "He smelled of an alcoholic beverage," "He had bloodshot eyes," "His speech was slurred." Also, the field sobriety tests are designed for humans to fail. Someone needs to call out MADD and the police for irresponsible policing and actually come up with proactive ways of preventing drunk driving other than arresting you if you have had one beer... Or a Sprite in Bieber's case as it would cause you to register a .14 too.
