Cops Claim of

Drag Racing Doesn't Hold Water

0124-justin-bieber-drivingMiami Beach cops claim Justin Bieber was drag racing at the time of his arrest Thursday ... but the facts seem to show the allegation is MADE UP ... because we've learned they were actually UNDER THE SPEED LIMIT in the middle of the so-called drag race.

According to the police report ... cops spotted Justin and his buddy Khalil drag racing at around 4 AM.

The police report says ... an officer observed the 2 vehicles reaching speeds between 55 and 60 MPH.

Now the problems.  

Cops say they noticed the "drag race" on the 2600 block of Pine Tree Drive.  Cops were traveling in the opposite direction so they made a U turn and pursued the cars for 15 blocks.

Mind you ... Justin was driving one of the fastest race cars around -- a Lamborghini Gallardo LP550-2 Spyder.  Khalil was driving a Ferrari 16M.  Cops claim 2 SUVs in Justin's entourage actually blocked off traffic to give the 2 a clear path.  

So how could a 15-block drag race in those cars reach speeds of ONLY 60 MPH?

Fact is ... THEY DIDN'T REACH 60.  IN FACT THEY DIDN'T REACH 50THEY DIDN'T EVEN
REACH 40.


TMZ has learned ... the place where Justin and Khalil rented the cars attached a GPS device that also tracks speed. 

The GPS clocked both cars at 27 MPH at the 3500 block of Pine Tree Drive ... smack in the middle of the so-called "drag race."

There's only one time they ever broke 50 MPH and that was long before the pursuit started.  When Justin and Khalil left the club, one car was briefly clocked at 52 MPH and the other 47 MPH. Both drivers slowed down pretty quick and 5 blocks before cops noticed them they were going 34 MPH in a 30 MPH zone.   Blocks later, they were steady at 27 MPH.

 So it seems cops goosed the facts to justify the stop.

And that's not the only problem with the police report.  TMZ broke the story ... Justin's blood alcohol level was .014 -- a barely measurable amount.  Yet cops claim Justin reeked of alcohol both at the scene and at the police department.

You should do your research before running an article cause you are talking out of your @$$. First all, Florida statue States drag racing is two or more vehicles side by side accelerating with the intention of racing . There is no set speed nor do you have to go above the set speed limit to be charged. Secondly, Justin is 19 therefore not a legal age to purchase or consume alcohol, therefore the standard BAC of .08 doesn't apply to him as he isn't old enough to drink.

TMZ posted the police report 2 days ago but obviously didn't read it. The speeding or drag racing was not listed under "charges".

Two days ago, TMZ also posted that Beiber's alcohol test was a .04 NOT a .014 which they are stating today.

Drag racing or not, you don't leave a club at 53 and 47 mph.

Also let's not forget the video evidence that shows him drag racing, or his confession of drinking and driving. Also, you can be charged with drinking under the influence with drugs, it doesn't have to be alcohol. I bet his blood has enough pot in it to give cheech and Chong a run for their money.

1) Regardless of speed, the two were racing, and they had their entourage illegally slow or stop traffic in order to do so on a public street. A high speed isn't necessarily needed for it to be a race. A short distance, straight stretch, and usually two competitors are also characteristics of a drag race. Sure, it's a boring race to watch, but when those participating have their minds focused on their competitor, and also think that the road is safe for them to take their eyes off of because their entourage is blocking of other traffic, then it becomes a hazard for the general public... perhaps if something were to unexpectedly occur up ahead, which could result in a third party party getting hurt or killed. In any case, just on those other issues alone, the traffic stop was reasonable.

2) You can still smell like alcohol, even if you haven't had much of it. Perhaps some was spilled on him, or inside the vehicle, who knows. Even if he was under the legal limit, he was also supposedly high from pot and pills, and that he wasn't terribly with it was obvious to the officer (he failed the field sobriety test). I would think they took a urine sample when they booked him, and results are just pending.

3) Bieber is still a little sh*t for driving with an expired license.

I don't believe the part about the speeds that registered on the GPS system. There's probably a bug and it doesn't work right. I'm sure the police used a radar gun or something and could see how fast they were going. The Bieb definitely broke a lot of laws even if he didn't speed. Like driving without a license, underaged drinking, taking his mommy's prescription drugs. Plenty of things to throw the book at The Bieb on.

if these aee really the true facts, Roy Black , on behalf of Justin, should sue the Miami police department for false arrest. I'm a supporter of law enforcement but not when they are this stupid. Somebody should have called in for a higher opinion once they knew they were about to make a celebrity arrest. It appears to be police harassment. Dummies!

Who is paying TMZ to post this nonsense? Yesterday TMZ posted the truth and now all of a sudden, they've completely REVERSED their stories. TMZ does this all the time. This kid is a POS. He eggs homes and has no regard for anything or anyone. What would you do if he spit in your face like he did the neighbor? I'd flatten this little snot.
