In DUI Case

Justin Bieber
and Miami Beach prosecutors will NOT strike a plea deal in his DUI case ... and sources connected with the case say a trial is now almost certain.

TMZ broke the story ... prosecutors are offering a no contest plea to reckless driving, with strings attached ... notably Justin must submit to random drug testing for 6 to 9 months.  Sources connected with Bieber say they will NOT accept any plea that has probationary terms ... especially drug testing.

Now law enforcement sources tell us ... they will not deal if Justin does not agree to random drug testing ... period.  As a result, both sides are at an impasse.

With a plea deal all but off the table, a trial is likely.  Law enforcement sources acknowledge there are problems with the arresting officers ... the fact that he may have lied when he said he smelled alcohol on Justin's breath (he blew a .014).  And another cop claimed Justin was drag racing (at 27 MPH).

Nonetheless ... we're told prosecutors are not afraid of trying the case.  And Justin's famed lawyer, Roy Black, is ready for a courtroom battle.

At stake -- Justin could be tried for 3 offenses ... DUI, resisting arrest, and driving on an expired license.  Worst case scenario -- 2 1/2 years in jail.

FL has the poorest conviction rate of any state in the country, and given the facts of no drag-racing (provable by gps and video), and a corrupt police officer who blatantly lied, going to trial is his best bet.

Negotiation mea ns both sides have to give up something.
He should meet them half-way. No contest DUI + 90 days of drug testing, pay fine for driving expire license. And they can throw out the thug officer's claim of resisting arrest.
A 90 day drug free period will do him some good.

How fast he was going when he was drag racing is irrelevant. Read the FL statute on the definition of drag racing.

He's not gonna do any serious time. Celebrities never do. Unless of course he's cheated paying taxes. That's the only crime celebrities go behind bars for 3 years.

No probable cause for the police contact - case closed. Harvey knows this, the cops have to have probable cause for the stop, any fruits of that stop are void if the cops lied and its proven they lied to make the stop.

Once again folks - JB is not going to jail. The Miami PD really screwed themselves with their own shena****ns - my advice to the Miami PD would be calm down a wee bit and re-focus some of their resources on real crime opposed to tailing celebrity brats.

Unless Pami bondi head Attorney General Gets invole in this. The people have been conacting her on her personal twitter account. Telling her to step in and Get a Judge to look at the traffic stop to make sure it was a legal stop. She maybe the only one that could stop it from going to trial. I got about ten to twentry people that said the stop was legal
