Truck Driver Charged With Death By Auto

The guy driving the Walmart truck that crashed into Tracy Morgan's limo bus Saturday morning has been charged with death by auto ... TMZ has learned.

The Middlesex County Prosecutors Office says 35-year old Kevin Roper was charged with 1 count of death by auto and 4 counts of assault by auto.

Roper's bail has been set at $50k ... and prosecutors expect him to surrender.

As we previously reported, Morgan was riding in a limo bus on the NJ Turnpike on his way home from a gig last night ... when it was rear-ended by an 18-wheeler and overturned.

Tracy and another passenger were airlifted to a nearby hospital where they remain in critical condition. Another passenger, James McNair, was pronounced dead at the scene.

According to reports ... Morgan's opening act Ardie Fuqua -- who posted a photo of Tracy roughly 30 minutes before the accident -- is also in critical condition.

Prosecutors say the cause of the 6-vehicle wreck is still under investigation.

I really think that tbe truck driver made a honest mistake. I drove for 10 years before my career ended due to my sickness.. But I do know the government cracks down on drivers for the most dumbest things! I pray everyone pulls through, just not Tracy Morgan but everyone!! I'm sure the driver is in state of shock. God bless the families during this dark time!!

If the accident is under investigation why is the driver being charged? An accident is an accident, tragic as it is, I don't understand the driver being charged. Was he high or drunk or did he leave the scene?

If you've ever been on the Jersey Turnpike with (most) tractor-trailer drivers, then you can understand how the charges were swiftly filed. Most of them have no regard for human life or others on the road. It's a "move or be squashed"; "I'm bigger than you" mentality. They follow too closely and this accident is the sad, unnecessary result of such reckless driving. My thoughts are with the families and friends of those injured and killed. I know truck drivers have to make a living, I get it, but they need to adhere to the rules of the road (for example, they aren't supposed to be in the left lane, not even for passing slow cars, yet they always are!). These rules are especially important when your vehicle (aka a semi) is 10 times the size (at least) of everything else on the road. Common sense and common courtesy.

Gregory Williams of New Jersey State Police."NJSP says the driver of the tractor-trailer failed to observe slow-moving traffic ahead," Williams said. "At the last minute, he swerved to try and avoid the Mercedes limo bus but struck it from behind, forcing the limo to rotate and overturn."

Shouldn't they investigate before the Walmart driver gets locked up? The driver could have been fatigued from lack of proper time off from the job. There could have been a mechanical issue. The potential for Walmart to be held responsible for this are high.

As a driver he probably was turn to get there on time but inexcusable for him, he should of took his time let them know he wasn't gonna make it I know it's all about money but your life and others life are more important.
