Truck Driver Charged With Death By Auto

The guy driving the Walmart truck that crashed into Tracy Morgan's limo bus Saturday morning has been charged with death by auto ... TMZ has learned.

The Middlesex County Prosecutors Office says 35-year old Kevin Roper was charged with 1 count of death by auto and 4 counts of assault by auto.

Roper's bail has been set at $50k ... and prosecutors expect him to surrender.

As we previously reported, Morgan was riding in a limo bus on the NJ Turnpike on his way home from a gig last night ... when it was rear-ended by an 18-wheeler and overturned.

Tracy and another passenger were airlifted to a nearby hospital where they remain in critical condition. Another passenger, James McNair, was pronounced dead at the scene.

According to reports ... Morgan's opening act Ardie Fuqua -- who posted a photo of Tracy roughly 30 minutes before the accident -- is also in critical condition.

Prosecutors say the cause of the 6-vehicle wreck is still under investigation.

How can the truck driver be charged if they are still investigating? People don't realize a big truck has way more weight and can't stop like a 4-wheel vehicle. I think they should find out what happened before they charge that guy for something that might not have been preventable...

When I used to drive an 18-wheeler, I used to snort crank to stay awake for 96 hours at a time, and I enjoyed it. Why didn't anyone ever explain that to this poor slob? Try to be professional!

Although I do not believe that Walmart would allow a Driver to operate a tractor out of D.O.T compliance the rigorous demands of trucking companies is a strain on Truck driver. Drivers are forced to stay away from their homes 14 to 21 days at a time and work 70 hr a week. Drivers sleep in truck stops that are often noisy and it is difficult to get restful sleep. The D.O.T regulations need to be revisited with actual trucker on staff.

This regulation in my opinion is simply void of public safety,( Truckers are restricted to the two right lanes on highways.)

The Right lanes are the lanes that have the most activity these are the lanes that you enter and exit the highway not to mention that these are the lanes that beginning drivers use. It is as if the D.O.T is using entering and exiting driver, and beginning drivers as speed bumps for commercial vehicles 80000 lb vehicles. This is simply not a safety conscious choice. The majority of Large trucking companies have their equipment governed below 65 mph for fuel economy so speeding is no longer an issue. When emergency situation arise like this one the driver is already in a compromised position because of the lane restriction so the choices are minimal and a choice has to be made in seconds. If Kevin Roper was not delivering in this area and the regulation did not restrict him to the high activity lane he would have had more options.
