8:00 AM PDT:  Robert Downey Jr. just released the following statement to TMZ: “Unfortunately there's a genetic component to addiction and Indio has likely inherited it. Also, there is a lot of family support and understanding, and we’re all determined to rally behind him and help him become the man he's capable of being." 

Downey adds ... "We’re grateful to the Sheriff’s department for their intervention, and believe Indio can be another recovery success story instead of a cautionary tale.”

s son was arrested for cocaine possession in West Hollywood Sunday afternoon ... law enforcement sources tell TMZ.

We're told Indio Downey was a passenger in a car at around 2 PM PT when cops drove up along side the vehicle and noticed the passenger was smoking something out of a pipe.

An L.A. County Sheriff's deputy pulled the car over, did a search and allegedly found cocaine in Indio's possession.  He was arrested and taken to jail for possession of cocaine.

20-year-old Indio -- who appeared in "Kiss Kiss Bang Bang -- posted his $10K bail and was released just after midnight Sunday.

Robert Downey Jr. famously struggled with drug addiction and ended up in prison.  The drugs that got him in so much trouble -- cocaine and heroin.

When I want to gauge racism in America, I always come to the commoner section at TMZ. When Whitney Houston was going through her struggles, she was all kinds of crack this and that. I mean some of the worst comments I have ever read. This white guy gets caught with a crack pipe and was smoking crack, you minimize the story... I know that God is one day going to settle the score on racism here in America.

Those of us who have dealt with addiction to any of the myriad of substances one can become addicted to, know that there is a genetic component to addiction--my heart goes out the recovering addict with a child who is demonstrating their own addition. Indo Downey’s arrest comes as a sad but not totally unexpected event. As many defense attorneys who have dealt with clients who have been arrested for substance abuse know, if there is a history of addiction within the immediate family other family members may also be using drugs whether just recreationally or on a regular basis. Substance abuse has a genetic component. I’ve seen this over and over with clients I have represented on drug possession charges.

Fortunately for Indo and other Californians, the California criminal justice system has evolved from the old model of incarceration for simple possession to treatment. Indo should be eligible for Proposition 36 or Penal Code 1000, both treatment based sentences.

Proposition 36 was approved by voters in 2000. It requires that eligible non-violent drug offenders serve their time in a drug treatment program instead of jail. If the person successfully completes the terms of the program, he/she can petition the court to dismiss the conviction. However, the arrest will still show on the record.
