Howard K. Stern's lawyer said just because Anna Nicole Smith's former bodyguard testified Howard liquefied Valium and injected it into Anna does not make it true.
Steve Sadow said when he cross-examines "Big Moe" tomorrow, there will be plenty of reasons for "serious doubt."

"Big Moe" -- Anna Nicole Smith's bodyguard -- just testified in the prelim that he saw Howard K. Stern liquefying a powerful drug in Anna Nicole Smith's bathroom.
Moe says he walked into Anna's bathroom in the Bahamas in October, 2006. Moe testified he asked Howard what he was doing, and Howard responded that he had just had a conversation with Anna and they decided cooking the Valium and then injecting it in her would work faster than taking a pill.
Moe says he then watched Howard load the syringe with liquid Valium but left before Stern allegedly injected her.

One of Anna Nicole Smith's bodyguards -- the one who tried reviving her the day she died -- told the judge in the preliminary hearing Anna was high on Ecstasy just before her bizarre appearance on the 2004 AMA awards.
"Big Moe" was referring to the video that was played in court yesterday. Howard K. Stern's lawyer tried explaining yesterday Anna actually had been suffering from seizures and that when she looked drunk and whacked out she was really reacting to anti-seizure meds.
But "Big Moe" testified at least on this occasion it was Ecstasy and Cristal that made her loopy.

The first witness in the preliminary hearing over Anna Nicole Smith's prescription drug death testified authorities found a baby bottle of Pedialyte on her bed, along with a bottle of Cipro.
Pedialyte is used to rehydrate children when they experience diarrhea and vomiting. Anna had been battling the flu.
Cipro is an antibiotic used to treat infections.
Anna was found unresponsive in her hotel room on February 8, 2007 at the Hard Rock in Seminole, Florida. Her cause of death was a sleeping med along with 8 other prescription drugs.
Howard K. Stern, Dr. Sandeep Kapoor, and Khristine Eroshevich are charged with fueling a drug addict's habit.

The preliminary hearing for the people accused of fueling Anna Nicole Smith with drugs kicks off today... and Larry Birkhead faces an almost impossible situation.
We're told Birkhead will testify either Thursday or Friday. Prosecutors will ask Anna's baby daddy about various comments he made about Howard K. Stern allegedly fueling Anna's drug habit.
But here's the problem ... Birkhead made these comments to TMZ and other media outlets during the time he was at war with Howard over Dannielynn.
Birkhead and Stern have not only settled their custody dispute and other differences ... they actually work together in handling all matters Anna Nicole.
So Birkhead is in an awkward position ... how does he back off his statements? Even more awkward, perhaps ... the prosecution is calling a witness who probably will not own the statements they're calling him to the stand to make.
The three defendants -- Howard K. Stern and two of Anna's doctors, Dr. Sandeep Kapoor and Dr. Khristine Eroshevich -- have all pled not guilty to a grand total of 23 felonies.

We've learned Larry Birkhead will be called by the prosecution in the Howard K. Stern preliminary hearing that starts tomorrow -- and we're told his testimony will center on Anna Nicole Smith's drug use.
Birkhead has said in the past -- when he was at war with Stern -- that Howard K. helped fuel her drug addiction. What will be especially interesting is whether Birkhead backs off the story now that the custody battle is long over and he and Stern have an alliance and now work together managing Anna Nicole's estate.
Birkhead's testimony could backfire on prosecutors if he says some of the statements he made were in the heat of battle.

Anna Nicole Smith's daughter Dannielynn and baby daddy Larry Birkhead got into the Halloween spirit this weekend -- and hit up the pumpkin patch for some face painting and pumpkin picking.
With the drug case against Howard K. Stern and Anna's docs heading to court this week, it's good to see these two can still carve out time together as a normal family.

We just spoke with the guy who triggered the murder-for-hire investigation into Anna Nicole Smith -- and he says she repeatedly asked him to kill the son of her late husband, J. Howard Marshall II.
Mark "Hollywood" Hatten, Anna's ex-BF, says a drug-addled Smith was continually "begging with me to kill E. Pierce Marshall" claiming after her husband died, Pierce was "standing in the way of her money."
Hatten says he told Pierce's lawyer about the alleged plot. Mark claims he was then interviewed by the FBI twice about the matter while he was in jail for an unrelated crime.
TMZ sources confirm that when Anna and Howard K. Stern met with the FBI, an agent told them Hatten was the one who made the claim. We're also told the agent didn't believe Hatten's story.
Ultimately, the FBI determined there was "insufficient evidence to establish that there was a murder-for-hire plot."

Anna Nicole Smith was investigated by the FBI over a possible plot to kill the son of J. Howard Marshall II -- the 89-year-old oil tycoon she married when she was 26, this according to newly released documents.
The investigation took place between 2000 - 2001 -- after J. Howard's death -- when his son, E. Pierce Marshall, was trying to keep Anna Nicole from getting a chunk of his father's wealth ... valued in the hundreds of millions.
According to FBI documents obtained by the Associated Press, authorities confiscated a couple of weapons from Anna's home during the investigation -- including a .357 revolver and a 3.5 inch stainless steel knife.
On July 3, 2000, Smith was questioned by the FBI, but according to the docs Anna, "began crying and denied ever making such plans."
Feds ultimately decided there was "insufficient evidence to establish that there was a murder-for-hire plot by Ms. Smith to kill Pierce Marshall."
Pierce died in 2006 from an infection.

Howard K. Stern was in court today -- where the judge set a date for the preliminary hearing in the Anna Nicole Smith drug case.
We're told, both sides combined, there will be at least 90 witnesses -- around 60 for the prosecution, 30 for the defense.
Stern was arraigned last month on 11 felony counts related to Anna Nicole's prescription drug use -- but today outside of court he was confident he'd be found not guilty.
He'll be back in court October 13.

Howard K. Stern's attorney, Steve Sadow, just spoke to the media outside of court, calling the charges against his client "BS."
Sadow said Anna Nicole Smith was "not an addict" -- adding Anna's health was Howard's "main concern."
Howard was arraigned on 11 felonies today -- Dr. Khristine Eroshevich and Dr. Sandeep Kapoor were both arraigned on six.
